Ocwen They can produce the original promissary note. Without no contract--No contract, no Owcen Friendswood Texas
This may help. I note sure of your laws in your state. It work in most states. I have had the same problems with Owcen--taxes, late charges, no one that speak English.....I found out in the law school I'm attending, They must produce a the original promissory note. This is impossible because there's never one. When someone goes court on must of the foreclosures any state, the lend-holder's attorneys always produce the a copy--never the original. You must sit down with the lender and see if they have original--most of the original notes are located in foreign countries in which it takes sometime years or a life time to produce . Just think about it, if you had a car and some one stated it not your. Could you get away without showing proof of ownership with a copy of the title.The judge would send you back motor vehicle department to get original. With a promissory note there is only one. Since most the notes are sold the dulling--they can only produce a copy. You must show the original car title. The same with Lenders. Don't let them fool or scare you with all their fantasy words meant to intimidate you. Most of my friend have won and have taken their houses without paying another note. It your choice. Lets take back America.Next, since most of the dullings like Owcen which falls under the F.T.C laws and by-laws, must follow strict regulations. For example, If you send a letter like the one below, you can suit if they write your back. You are telling them, they are require by for you to take this up with the original lender-holder--which there is none. If they do, file a compliant with the F.T.C.Ref: Centerpoint Energy Enetex\Account Number: Dear Sir, This letter will serve as your legal notice under Federal Law that regulates the activities of collection agencies and their legal representative. You are hereby notified under provisions of Public LAW 95-109, Section 805-c, The Fair Debt Collection Practices Act, to hereby Cease and Desist in any and all attempts to collect the above debt. Your failure to do so WILL result in charges being filed against you with the State and Federal agencies empowered with enforcement. OCWEN SCAM Katy Texas
Actually I have the same problem with a Loan Modification Agreement, they offered me in December 2007, I sent the check and then, they said that they didnt receive the Loan Agreement Signed and they placed my payment as a "Partial Payment" and originating Late Charges, Property Valuation Fees and other freaking and invented Fees.
I made a claim to the Office of Financial Regulation, Division of Finance 200 East GAines Street, Tallahasse, FL 32399
Pleae write a letter to them along with copies of the statements, letters, etc.
Send the same letter with proof of the situation at: Federal Trade Commsion, Consumer Response Center, 6 th and Pensylvannia Avenue, NW, Washington DC 20580. We need to push together, this is the only way.We need a lot of people making the claim with the same problem so that the Goverment can do something. I sent the letter and they sent me back a letter stating that they are going to inspect what is going on.

Ocwen Loan Servicing Bank What you did in the dark OCWEN will show up in the light (i.e. Court). West Palm Beach Florida

I have been fighting with OCWEN for the last two years since my loan was sold in 2005. I have received certified letters from Ocwen saying that my loan is in default and I owe over $9,000.00 and I am in jeopardy of defaulting on my loan agreement. In return I sent Ocwen a certified letter stating that I disagree with this amount due to the fact that I requested the escrow fees to be cancelled and we would pay our own taxes. Ocwen told us they can not discontinue our impounds because it is too much of a risk. Then our payments increased without prior notice of about $400.00 our contract said the payments were not suspose to increase untill October of 2007.
I called Ocwen but could not understand the rep I was speaking with and nothing was resolved at that time. I sent prearranged bi-weekly payments the payments were diposited before the time agreed an resulted in my check being returned. Ocwen then refused my payments unless I paid by cash only.
They then wanted late fees, attorney fees, and other fees that I have never heard of, I asked if they wanted my first born too. I ended up contacting a lawyer because they sent me a letter saying my home was on the auction block. In the end I paid over 21k to bring the account back to contractual agreement, ( yea right!). The lady oops! wrong choice of words, the ocwen employee Evelyn said she cannot guarantee that the loan will be reinstated. They then ask for anoher $3000.00 for some other bogus fees. I told them they had better take that 21k and leave me the hell alone. To this day Ocwen have not updated my information with the credit bureaus and I am unable to refinance because of negative reporting. My prayers have been answered. Finally GOD has sent Mr. Hanson to the rescue.

Ocwen Mortgage refused payments, charged multitude fo fees totaling $1000,s tried to force forclosure 3 times Orlando Florida, California

I filed chapter 13 in 2001 from divorce, ocwen refused payment so my bankruptcy attorney Gardner Law firm set up to make payment 4 times and had to go to the judge to get them to accept payment.Ocwen began charging me many different kinds of fee's for bankruptcy, legal ,several property inspection and maint. totaling several thousand dollars.On three occaisions they refused payment untill I paid fees, charged me late fee,s and payments I did not owe to force forclosure. I was told on several by different individuals that they intended to forclose on me because I had a lot of equity and they would do what ever they could to do this.In Dec of 2003 I wired them before 5:00 them aprox. $8600.00 (4 payments they refused and 2 payments I did not owe so as to include all fee's due to date). I did not have to make payment until Feb.of 2004 due to overpayment. March of 2004 they refused payent as I owed $1700. in fees, I started to seek refinancing, they told me they would and did do what they could to ruin refinancing, and started forclosureTo this day they are holding a payoff check, they paid taxes after being told they were already paid and charged $12,000. for fees again. I have conflicting information from them and hard copies of almost everything I have listed. I have witnesses 2 attorney's and 2+ mortgage co's that can verify how hard it is to deal with them, they disconect you eveytime you call and give you false information, put you on hold for 30 mins. or more. I have more information available and names and phone numbers if needed. also these individuals will write statments as to the fact.Rogerlong beach, MississippiU.S.A.
