NCI Ocwen Harassment.. after paying the agreement settlement amount Alanta Georgia

I am on disablity, which means I live on a very limited income. I recently called this company {Ocwen} to try and settle the account. After explaining my situation to them and discussing possible payment arrangements. We agreed that if I paid them nine hundred dollars it would settle the account and they would close it and report the account closed to the credit agencies
.I did not have that kind of money, but I was able to borrow it from someone I knew. I sent them a cashiers check priority mail. I also included a letter with the check stating it was the settlement amount agreed upon and it would close the account, meaning the account was paid in full. They called the message number I agve them a few days later and informed me they received the check, but they wanted more money. I refused to pay them any more money and told them I was going to get legal help. Now they are calling the message number I left and harassing the person who lives there. It's a crime that companies like this can hassle people and cause them so much emotional and financial distress. I hope that every lawsuit against them is won and their company is forced to close for good.

Ocwen Bank Complaints - Overcharging for escrow, and interest

I believe Ocwen bank overcharged me thousands of dollars in junk fees, overcharging for escrow, and interest. They refuse to verify charges and then allegedly you are behind and during the request for account information. they allegedly assigned the loan to LaSalle Bank trustees of a 1998 R-1 pass-through certificate.(what ever that is, some kind of security).LaSalle Bank filed a foreclosure the day they were assigned the note by OCWEN. They waited 3 months before filing with the court clerk they were the new owners. I found out Lasalle was the owner the day I was served the foreclosure.OCWEN filed papers with the court they were the owners of the mortgage in 1997 when HUD sold them my loan. When I called LaSalle Bank they told me they had owned my property with this alleged pass-through certificate since 1998. I have never received anything from LaSalle Bank. This case is still pending due to other issues. I still receive bills from OCWEN even though they allegedly assigned this loan to someone else.I would have thought they would be required to notify me of the transfer. I still do not understand how LaSalle can forclose with ownership in securities related to this property that they bought in 1998 but never filed with the court until after they filed the foreclosure, but still have OCWEN service the loan.I may lose my home. My husband is disabled.
All of this smells fishy!

OCWEN Mortgage Loan Servicing, LLC RIP OFF SCAM artists West Palm Beach Florida

I hate dealing with Ocwen Mortgage. I guess that is a mild understatement. Ocwen bought my mortgage 1 1/2 years ago and it has been nothing but headaches and BS since then. My mortgage has went up twice, without notification and they have messed up my escrow now. We are behind by my choosing, because of the escrow. There is $1024.35 that Ocwen got from us but can't seem to tell us where that money went and/or why. I have done the math and it doesn't work. I changed my insurance company in March to lower my payments. I was paying $4800.00 a year for homeowner's insurance and now I'm paying $2605.00. (Ocwen mailed out payments to both and I am fighting to get the money back from the insurance company that I cancelled with.) Also, my homestead exemption kicked in as of Jan 1st 2008. I called and guess what? They hadn't applied it to my mortgage. I fought like hell to get it in place. (2 months time, BTW.) My payment should have gone down by close to 600.00 a month. But, they called on Friday to inform me now that my mortgage payment has gone up, ironically the exact amount of money that I saved via insurance and taxes to the penny. LOL. Also, to inform me that they don't pay my taxes, although they have for 2 years and it is in my contract that I make one payment, which includes prin+int+ins+taxes. They state that they have paid my taxes to date simply as a courtesy. LOL. A courtesy? How about this, per my contract? They did not have the original contract in front of them and the girl tried to start bullying me. LOL. I don't bully easily. It's simply not worth it to me. Now they have called 26 times since July the 1st and 50% of the time when they hear my voice they hang up. You can hear the typing in the background. LOL. They did call and asked for my husband, and he says 'My wife handles all of the finances.' I kept them on the phone for 49 minutes yelling at them and asking them to get it together. That was pointless. Here is the other funny thing, I am NOT on the loan, I am strictly on the title. Yet, they report it late on MY credit. ILLEGAL!!!! I did not sign, not one document in regards to the loan, my husband did. I have spent so many hours dealing with them and have yet to speak to the same person twice. There is always a different story. I refuse to submit to them and I refuse to allow myself to be ripped off any longer. I am trying to find an attorney who will help start a class action suit. It seems that this needs to be done. Although after much research I realize that the courts usually side with Ocwen. Ocwen makes sure that the venues get changed to where there are more favorable judges (my guess judges that own stock or being paid on the side, it's sad but this is our country.) I have resolved myself to letting go of the property and letting them lose money on their investment. Currently, we owe $326,000. The house is valued at $250,000 in this market. My husband and myself have realized that the stress from dealing with Ocwen isn't worth our health or happiness. Quite honestly, it pleases me to no end that they will lose money in excess amounts. LOL. I have gotten to the point where I actually make fun of the people when they call me. LOL. I know it sounds childish but when you are dealing with them and can't get a straight answer or speak to somebody that speaks ENGLISH, I'm kind of left with little else, except wait for them to foreclose. Which I am doing. I love my house very much but not at the expense of my family. Ocwen's stock has been on a steady decline for about a year and a half. Sound familiar? That was when they took over my loan. My advice to all or some, is simply this: let go. Let Ocwen suffer the loses. I have given up on the fact they will help the situation or fix their problems and I'm NOT going to pay them another red cent. They can kiss my a**. :-) I believe in a matter of time the government will step in and Ocwen will lose their a**es. I will try and find an attorney in the meantime to try and help us out of this pickle, even bankruptcy. If and when I find an attorney that is willing to help ALL of us out and away from Ocwen, I will post his/her name for all of you and every site that I can. I would rather an attorney make money than them. If any of you get an attorney that is willing to handle this, please post their name for others. I wish you all well and hope that you all get away from Ocwen. I read that somebody called them The Mortgage Mafia. LOL. How true. Remember this, it's just a house. It's not worth you or your happiness or your family's health or happiness. It is simply a material possession that can be replaced. Let Ocwen suffer the losses, not you. Life sucks as it is right now don't let them make it worse. Take Care.

Mortgage Nightmares Come True

From: http://www.cbsnews.com/stories/2003/11/28/eveningnews/main585953.shtml

(CBS) Jo Scheck's American dream -- her own home -- was lost when the mortgage payments for her Bel Air, Md., townhouse skyrocketed. "You get this letter April 3, 2000, telling you that your mortgage payments have been increased by $400 a month?" asked CBS News Correspondent Randall Pinkston. "Right," Scheck replied. For years, she'd paid $900 until her mortgage servicer, Ocwen Financial Corporation, said they hadn't collected enough for the escrow. Ocwen reduced the payments by $100, but not enough for Scheck, who was forced into foreclosure. "This is a mistake that they admitted making. They said, you know, sometimes things like this fall thru the cracks," she said. In Hartford, Conn., Kweku Hanson claims Ocwen tacked on homeowner insurance he didn't need, and never credited the thousands in extra payments he'd made on his loan. "The money went to Ocwen, that's all I know," Hanson said. "How much do you think you've lost?" asked Pinkston. "I would say at least $8,000," Hanson answered. Hanson has filed a lawsuit against Ocwen alleging unfair consumer practices. Ocwen calls his charges baseless. Hanson and Scheck are among hundreds of homeowners who have complained about Ocwen's mortgage servicing practices -- complaints that include misapplied payments, bogus late fees, and erroneous threats of foreclosure. "We've seen many consumers who have proof of their mortgage payments but nonetheless are receiving harassing phone calls, default notices and legal complaints leading to foreclosure, inappropriately," said David Berenbaum, National Consumer Reinvestment Coalition.. In a statement to CBS News, Ocwen says they "resolve delinquencies in eight out of ten cases..." that there's "no financial benefit to Ocwen in foreclosing..." Ocwen says they are "closely monitored by federal regulators." In 2000, the U. S. Department of Housing and Urban Development determined that Ocwen had violated rules and regulations on loans Ocwen serviced for HUD. Ocwen agreed to pay $50,000 of HUD's costs to settle the accusations. "There's a real need, I'll add, for better policy and regulation of our mortgage industry especially in the sub-prime marketplace," Berenbaum said. At the least, Jo Scheck wants an apology for her foreclosure -- one she believes should never have happened.

Ocwen Loan Servicing Bank What you did in the dark OCWEN will show up in the light (i.e. Court). West Palm Beach Florida

From: http://www.ripoffreport.com/reports/0/312/RipOff0312761.htm

I have been fighting with OCWEN for the last two years since my loan was sold in 2005. I have received certified letters from Ocwen saying that my loan is in default and I owe over $9,000.00 and I am in jeopardy of defaulting on my loan agreement. In return I sent Ocwen a certified letter stating that I disagree with this amount due to the fact that I requested the escrow fees to be cancelled and we would pay our own taxes. Ocwen told us they can not discontinue our impounds because it is too much of a risk. Then our payments increased without prior notice of about $400.00 our contract said the payments were not suspose to increase untill October of 2007.
I called Ocwen but could not understand the rep I was speaking with and nothing was resolved at that time. I sent prearranged bi-weekly payments the payments were diposited before the time agreed an resulted in my check being returned. Ocwen then refused my payments unless I paid by cash only.
They then wanted late fees, attorney fees, and other fees that I have never heard of, I asked if they wanted my first born too. I ended up contacting a lawyer because they sent me a letter saying my home was on the auction block. In the end I paid over 21k to bring the account back to contractual agreement, ( yea right!). The lady oops! wrong choice of words, the ocwen employee Evelyn said she cannot guarantee that the loan will be reinstated. They then ask for anoher $3000.00 for some other bogus fees. I told them they had better take that 21k and leave me the hell alone. To this day Ocwen have not updated my information with the credit bureaus and I am unable to refinance because of negative reporting. My prayers have been answered. Finally GOD has sent Mr. Hanson to the rescue.

Ocwen Loan Servicing, Ocwen violates Section 6 of RESPA and various other laws West Palm Beach Florida

From: http://www.ripoffreport.com/reports/0/312/RipOff0312432.htm

Well, I too have had nothing but problems w/Ocwen. I have sent several dispute letters and all have been competely ignored... they are considered 'qualified written requests' under section 6 of RESPA. These are violations here, inaccurate credit reporting, fees being charged, etc. Just the same thing you continually hear about Ocwen. When is the government going to wake up. Why is a business able to break the laws, but we get knocked for everything. They want my money and my house, well, it's not gonna happen. Here is also a link I found...look at what they make!!
http://www.cfonews.com/ocn/f032406.txt
pretty interesting what these people make and yet my husband risks his life every day and doesnt make 1/4 of what these people make and they want my little house too!

Ocwen, Allegations of Fraud, Malice, Misrepresentation and Manipulation.

From:http://www.msfraud.org/Articles/The%20Ocwen%20Story.htm

Voice of the People

Ocwen, Allegations of Fraud, Malice, Misrepresentation and Manipulation. Ocwen Financial Corporation ("Ocwen") is a vertically integrated multi-billion dollar, publicly traded (NYSE: OCN) financial services holding company, engaged in a variety of businesses related to mortgage servicing, real estate asset management, asset recovery and technology. Headquartered in West Palm Beach, Florida,Within a 12 month period this company has lost two major lawsuits alleging fraud, malice, misrepresentation and manipulation totaling $14.5M. Other allegations have been made by former and current employees including the intentional destruction of information, and document forgery. Why do so many people claim that Ocwen is ripping them off and wrongfully foreclosing on their homes? Is Ocwen really the bad guy?Or are their customers failing to meet their obligations and looking for a quick court buck? This is the first in a series of stories about this company, Ocwen services sub-prime mortgages. This means they service mortgages for people that have had trouble paying their bills in the past. And Ocwen services a lot of these, nearly 400,000 customers. As part of this investigation we decided to review a typical Ocwen customer, and a not so typical Ocwen customer. We will call them Mr. Smith and Mr. Jones (these are real Ocwen customers) who have ask to not be identified because of pending legal action.Mr. Smith just had the loan servicing rights acquired by Ocwen in August of 2005. Mr. Smith has homeowners insurance through Prudential, his premiums are paid and current. In September of 2005 Mr. Smith paid his regular monthly bill to Ocwen with his old account #. Mr. Smith had not received his new payment information from Ocwen and did not want to be late on his payment. Ocwen cashed this payment and on Sept 22nd sent him a letter (to the wrong address), stating he was late on house payment this letter did not contain his new account and payment information.Mr. Smith contacted Ocwen numerous times in writing and on the phone trying to resolve this matter. Many times Mr. Smith would be routed to customer representatives that spoke very poor or unintelligible English or would be disconnected. In October Mr. Smith still had not received his new payment information and again sent another payment to Ocwen, which again they cashed and again sent a letter, this time threatening foreclosure. In November of 2005 Mr. Smith finally received his payment information, the statement showed he was 4 months behind (yes 4 months when he had only been a customer for 3) in his payments and fees had been added that he did not understand, such as homeowners insurance and legal fees and late payment fees, totaling almost $2600. Mr. Smith made another payment in Nov 2005 which was returned by Ocwen stating they could not accept partial payments.Mr. Smith was now receiving nearly daily calls from Ocwen collections, and Mr. Smith responded in writing trying to rectify the situation. In December Mr. Smith received another statement again with a promise of foreclosure and new fees added in order to become current Ocwen now claimed he had to pay a sum of almost $3600.Now these fees were different from the statement he had received the month before for the same items. Homeowners insurance went up $120, legal fees increased by $277 and the house payment itself went down by $38.
Mr. Smith wanted to refinance, but it appears Ocwen has already contacted the Credit Bureaus and reported him being late, he can’t get refinanced. How is this possible?A former employee claims he knows exactly how it’s possible. “The RealServicing software used by Ocwen and the Nightly Processing that reconciles the loan accounts doesn’t work and hasn’t for several years. That’s why customers get different payment information from month to month. It was a running joke in IT on how long the system would be down everyday when it ran. This whole process generated huge error logs that no one ever reviewed and it had been clear to everyone involved in the process that it has major problems”.Ocwen has sued a former consultant that performed a review on this software claiming he has posted confidential information on the Internet and reported this information to Government Agencies and this consultant has already testified in a case against the company in which Ocwen was hit with a $3 Million verdict in Guzman V. Ocwen. This testimony was specific on the problems with Ocwen software and account reconciliation. We contacted this consultant for comment and were informed that because of an Injunction granted to Ocwen he could not discuss the matter, and was prevented from testifying in another case in which he was listed as a witness and the jury awarded the plaintiff $11.5 Million in damages in Davis V. Ocwen. However a hearing was being set to Vacate the Injunction that prevented the consultant from discussing the details of his work at the company. Other former and current employees have confirmed this information and noted that Management has been aware of these issues at the highest levels inside the company. Two employees have even tried to get the company to take action to resolve the problems but have not been successful.WOW. If the company is aware of these problems why haven’t they done something to fix it?Ocwen has not responded to these specific issues yet but has commented and currently claim that they are not intentionally foreclosing on homes. The CEO William Ereby has stated publicly that the company doesn’t make money on foreclosures that their profit comes from servicing the loans themselves. If this is true then why are their an overwhelming number of reports freely available on the internet that confirm the Mr. Smith experience with the company? Why are there so many lawsuits pending against Ocwen?Next month we will continue this series on Ocwen and report on Mr. Jones a very unusual Ocwen customer.

Ocwen Loan Servicing unexplained bogus fees i didn't sign up for, loosing pmts always saying im late, increase mortgage pmt on a fixed rate loan Orlando Florida

Hi , I have been dealing with Ocwen for about 7 years and it has been hard in 2002 I had to file chapter thirteen but Ocwen was not under the chapter 13. I paid ocwen outside my chapter 13. i started receiving statements saying i owed them 1600.00 for payments not made i made the payments but at that time I had misplaced my Western Union receipt for my proof ( I know my fault) but i ended up adding the 1600.00 dollars on to my chapter 13 to keep them from foreclosing on my house. I made my chapt.13 pmts the were drafted from my pay check every payday. My attorney then informs me that ocwen sent in a petition and added a extra 800.00 more dollars I asked questions I attorney tried to contact them but of course they used the law against me to protect them they refused to talk or give any info pretaining to my account as long as i was under chapt.13. Now I have since been discharged for chapt.13 now ocwen has added alot of bogus charges such as Ocwen financial insider, foreclosure fees. Now I have been making my pmt on time i still use western union but i keep all my receipts now they have sent me a letter statting i am past dueas 12/21/07 3071.24. i don't know how thats possible but i know this company isn't right. if there anybody out there that can help me please come forward.Nikkimacon ga, GeorgiaU.S.A.

Ocwen Mortgage refused payments, charged multitude fo fees totaling $1000,s tried to force forclosure 3 times Orlando Florida, California

From: http://www.ripoffreport.com/reports/0/297/RipOff0297232.htm

I filed chapter 13 in 2001 from divorce, ocwen refused payment so my bankruptcy attorney Gardner Law firm set up to make payment 4 times and had to go to the judge to get them to accept payment.Ocwen began charging me many different kinds of fee's for bankruptcy, legal ,several property inspection and maint. totaling several thousand dollars. On three occaisions they refused payment untill I paid fees, charged me late fee,s and payments I did not owe to force forclosure. I was told on several by different individuals that they intended to forclose on me because I had a lot of equity and they would do what ever they could to do this.In Dec of 2003 I wired them before 5:00 them aprox. $8600.00 (4 payments they refused and 2 payments I did not owe so as to include all fee's due to date). I did not have to make payment until Feb.of 2004 due to overpayment. March of 2004 they refused payent as I owed $1700. in fees, I started to seek refinancing, they told me they would and did do what they could to ruin refinancing, and started forclosureTo this day they are holding a payoff check, they paid taxes after being told they were already paid and charged $12,000. for fees again. I have conflicting information from them and hard copies of almost everything I have listed. I have witnesses 2 attorney's and 2+ mortgage co's that can verify how hard it is to deal with them, they disconect you eveytime you call and give you false information, put you on hold for 30 mins. or more. I have more information available and names and phone numbers if needed. also these individuals will write statments as to the fact.Rogerlong beach, MississippiU.S.A.

Ocwen Loan Servicing ocwen helps get you deeper into financial trouble. they call it a forebearance plan Orlando Florida

From: http://www.ripoffreport.com/reports/0/296/RipOff0296936.htm
last year we signed a forebearance agreement to avoid foreclosure. our payments went up $200. we paid every single month on time, though often they didn't deposit our checks until the day after the grace period. creating a late fee. though we contacted them thier response was 'send you payment earlier.' what if we didn't have the money in the bank earlier and by some miriacle they made a swift deposit. then we pay a late fee and an overdraft fee.and you are charged an insuffecient funds fee by them. our complaint is, after a year of payments we recieved a huge tax bill with notice of intent to sell our property. ( from the state). we notified ocwen to find out what it would take to pay off the forebearance and all fees and escrow deficits. we were informed that we were 3 months behind and it would take about $14,000 to get us back on an even keel and get our payments reduced to the original payment. our monthly bill never reflected any info about this. an unhelpful sarcastic foriegner at ocwens customer service informed me we were only making forebearance payments and were still behind. asking what months we were behind she said, oct., nov., and dec., 2007... what? the past 3 mos. which we paid and she agreed we paid, but claims we only paid the forebearance.. the same amt. we'd paid every mo. for a year but for some reason the rules changed in oct. the amt. of the original forebearance was $8000. after 1 year we owe $14,000. the more we pay, the more we owe. we only owe 13 years on the house, but it isn't worth trying to save at this point. we didn't choose ocwen, our loan was sold to them when our original company filed bankruptcy. they inherited our insurance dept. and a $12,000 insurance settlement due us after hurricane francis was lost in the shuffle. we still had to pay the premiums to ocwen. no one knows where the insurance money went. why can't our gov. regulate these thieves and protect us. if ocwen offers you a forebearance agreement to save your home, get a lawyer first. it hasn't helped us.we struggled for a year when thier intention was always to get more money and the house in the end. well, the jokes on them.. remember that hurricane?Edwardlakeland, FloridaU.S.A.

OCWEN LOAN SERVICING, LLC ANYONE FOR A CLASS ACTION SUIT AGAINST OCWEN LOAN SERVICING, LLC ORLANDO Florida

From: http://www.ripoffreport.com/reports/0/295/RipOff0295279.htm

After reading many of the reports filed on this site, it has come to my attention that it is time the home owners should file a class action suit against this company. I too have had the same problems as many of you that have already reported. We were given to Ocwen when Aegis Mortgage Company filed Bankruptcy. We were on a forebearance program and then in November were sent a letter to bring the account current, that we would longer be on the forebearance program. The first certified letter came November 16 with a demand payment by December 16. Then we get a second certified letter dated November 19 with a demand payment for 1/2 the payment of the November 16 letter to be made by December 16. Then we get a third certified Demand letter December 17 demanding payment by January 17 with the same amount of money due (adding $5.21 more to the payment) that was due in the November Letter. We are current with our payments. We have proof of this. So what they are trying to pull, just does not make sense and to reach them by phone is a nightmare. To email them, you are really lucky if you get a reply of which they claim they will replay to you within 15 days. Whoop tee doo!! According to the Govenment Pamphlet on Fair Credit Practices, Section 805, clearly states that frequent calling (of which no one is on the other line either) is a form of Harrassment and is illegal. Well, with reading all the reports that have been given on this web site, maybe it is time that a class action lawsuit be filed to wake the company up. Oh, by the way, when they outsource to third world companies, and then ask for my social security number, are they crazy!!!! There is no way in 'Gods Green Earth' I am going to give anyone outside the United States my Social Security Number. I contacted my attorney and she said we have a great case. Maybe someone should put their money where their mouths are and prove to others that they honor what they say on their Web site. Do I have any takers. If you are interested in going with me in a class action law suit, please contact me through this web site and I will find a way that we can all communicate to get one started. I will watch this site daily to see how many people are really serious about starting the procedure. Without you there will be no releif for so many of us and more in the future.CarlSacramento, CaliforniaU.S.A.

Ocwen Can you believe this Orlando Florida

From: http://www.ripoffreport.com/reports/0/292/RipOff0292674.htm

I am horrified at this site. How many people have to write basically the same story before the curtain falls on Ocwen. I am currently in foreclosure with a foreclosure sale date from this horrible company. I am appalled at the entries from Ocwen employees ( if any of them are employees of Ocwen and not the company lawyers themselves ) even suggesting that the endless amount of customers including myself that are being victimized by this company are somehow at fault or overextended or didn't understand mortgages. I ( like so many of you ) have written, called, put on hold for 45 minutes then hung up on for one solid year.I believe it's important to note: I DID NOT CHOOSE OCWEN, THEY CHOSE ME!!!!In summary of my nightmare with Ocwen - Dec. 2006 they bought my note from Indy-Mac. They sent my first notice in Jan. 2007, they never applied my Dec. 2006 payment made to Indy-Mac and the horror began. I called constantly, wrote to them constantly - never got any additional response except that they had no record of the December payment - no kidding, in my letter I explained the Dec. payment went to Indy-Mac. The late charges began with every month, in July 2007 - I didn't receive a payment coupon - but soon, letters from an attorney for foreclosure.I have written to my Senators, Governor, Attorney General, Banking Regulators in New Hampshire to intervene. I asked Ocwen for an amount to bring my mortgage into current and good standing, told them I had all the money for the 'real' payments. NO RESPONSE except a letter from their Massachusetts lawyer giving me a Foreclosure date.Good to know the law firms of this country like working for the crooks, must be better money than honesty, integrity, and everything our system is suppose to represent. Please note: the law firm of KORDE & ASSOCIATES in CHELMSFORD, MA. are working for the crooks and have no problem with it.I am facing foreclosure in January, have hired an attorney ( like I can afford to waste money there ) and will sue Ocwen for the rest of my life if I have to. I am lost as to why our government, local, state and federal doesn't come storming up to the doors of this scum outfit and arrest everyone there, including each employee from janitor to CEO ( employees just because you would have to be stupid or a thief to work there ). What's it going to take to get action - while Ocwen continues to ruin hard working people's lives.Entry after entry ( to include mine ) say the same thing over and over - what does the government think - all of us that according to government officials should not have HOMES to begin with, as the Senator from Massachusetts Barnie Franks -Democrat says - got together and made this up.We are in the ( love this term ) SUB-PRIME market because 'A' Banks won't even talk to us - apparently they (Banks) know better than we do what we can afford or really who should have HOMES. We (I) need ACTION, not a huge amount of entries that state the same horror story. The ACTION required - scum like Ocwen, Option One, Wells-Fargo need to be forced out of business and all our mortgages need to be secured FIXED with a reasonable interest rate. No more words

Ocwen Loan Servicing - Ocwen Federal Bank ripoff Breach of Settlement Agreement West Palm Beach Florida

From: http://www.ripoffreport.com/reports/0/269/RipOff0269655.htm

Ocwen,(which is NewCo spelled backward) filed a foreclosure action against me in Feb of 2004. After 36 months of litigation, we finally reached a settlement agreement in Feb. of 2007. As part of the agreement, Ocwen was supposed to remove all negative reporting from the credit bureaus. As of August,2007, they have failed to comply even though a Judge ordered them to do so on July 30, 2007.Their modus operendi is to target borrowers who have lots of equity in their properties. Then they will back date the start date to pay, for example in my case from May 1, 2002 to March 1, 2002 (thus putting the person two months in arrears from the get go). Next they will claim not to have received a payment (ie in my case the Nov. 2003 payment).Luckily for me, I saved all my paperwork and my cancelled checks, so I was able to prove to their third attorney that they were wrong. Their first attorney realized they were wrong back in 2004 and wanted to settle so they got rid of him and found another shister to try and save their case. Luckily for me, she blatently forged a stipulation and was detected by the Judge. She was removed and faces charges. At this point, their third attorney realized it was time to settle since they had no case.Ocwen took revenge by failing to clean up my credit and is thus preventing me from refinancing. Truly, this is a criminal organization and needs to be put out of business permanently. They already had to give up their Federal Charter in 2005 because of the heat. They can not survive with their colections of nickels and dimes so their profit center is bogus foreclosures.MichaelTampa, FloridaU.S.A

Texas jury rules against Ocwen for $11.5 million

From: http://southflorida.bizjournals.com/southflorida/stories/2005/11/28/daily20.html

Wednesday, November 30, 2005
A jury in Galveston, Texas, has awarded $11.5 million to a customer of Ocwen Financial Corp. and its former Ocwen Federal Bank subsidiary, after determining they committed fraud in servicing her home equity loan.
The verdict against West Palm Beach-based Ocwen Financial (NYSE: OCN) and Ocwen Federal was issued Tuesday in Texas's 212th District Court. The jury ordered the Ocwen companies to pay Sealy Davis $10 million in actual damages and about $1.5 million for mental anguish and economic damages.
Ocwen Financial had $1.3 billion in assets on Sept. 30, according to its Securities and Exchange Commission filings.
The jury found the Ocwen companies made fraudulent, deceptive and misleading representations to Davis after she missed a loan payment while hospitalized in 2003.
Documents filed in the civil suit assert Ocwen began demanding additional money to make up for the missed payment and then began foreclosure proceedings on Davis's home in Texas City, Texas.
Davis retained the home after filing for Chapter 13 bankruptcy protection, court documents state.
Davis, in 2002, got a $31,000 home equity loan from Aames Home Loan with Deutsche Bank as trustee. Ocwen Federal Bank serviced the loan, including collecting payments.
The jury determined Ocwen contributed 100 percent to a wrongful foreclosure and none of that activity was attributable to the other defendants, Deutsche Bank, its law firm Baxter & Schwartz and several attorneys with that firm.
William Erbey, Ocwen's chairman and chief executive officer, and Kelly Herzik, a Wichita, Kan.-based attorney who represented Ocwen, did not return phone calls.
The Business Journal's questions included whether Ocwen might appeal the verdict to a Texas court of appeals.

Ocwen Loan Servicing - Lender & Servicer

From: http://ml-implode.com/ailing/lender_OcwenLoanServicing_2007-03-05.html

2007-03-05
A reader sends in this report on a former bank and now only loan servicer & lender, which seems to have been largely predicated on fraud:

OCWEN LOAN SERVICING Orlando, FL 1-800-746-2936
Services loans for the former Aames Home Loan dba Aames Funding Corp. They used to be a bank, OCWEN FEDERAL, until they ran afoul of the OCC. Now they're just one of the worst predatory loan servicers and lenders. Here's a sampling of the litigation they're currently facing:
Borrower Class Action Lawsuits: Over 500 separate class action lawsuits have been combined into one jumbo class to be heard in the Northern District of Illinois. Former employees testifying about how OCWEN intentionally defrauds borrowers -- it's built in to their software which was designed by this IT guy who is blowing the whistle.
Employee Lawsuit(s): Settling in favor of the Plaintiffs
Investor and Supplier/Vendor Lawsuit(s): Just getting started
U.S. Federal Government Lawsuit(s): According to OCWEN's SEC filing, they are being sued by the U.S. in the amount of $700 million +. Suits arose after one of their subsidiaries filed for bankruptcy protection in the District of Delaware Bankruptcy Court for that amount - $700 million in debt. Here's the part the Feds and the investors are upset about: This subsidiary transferred ASSETS to OCWEN just before filing on their liabilities. That's called a fraudulent conveyance.
Other Lawsuits: Everyone's suing them.
According to the SEC and OCWEN's own report, their net worth is $325 million--oops not enough to satisfy the Feds and investors. Borrowers who were defrauded and wrongfully foreclosed are at the bottom of this 'crumby' food chain.
According to Moody's Rating Service, they've decided not to rate OCWEN's stock--this after downgrading it. The $325 million may be a negative $325 million by this time.
SOURCES
My online sources included the public records found at Moody's, the SEC, Delaware District Bankruptcy Court, George Miller, Trustee, and The Rip-Off Report and others.
Looks pretty bad.
