Ocwen Loan Servicing Escalated payments, failed to credit payments or credited late, refused payments while in forebearance negotiaions, then wants $150,000 extra Orlando Florida

Ocwen takes the prize for most dishonorable company, and we want a class action suit against them! Anybody game?We have tried to keep up payments, but with an ARM, this became impossible, as our rate went to 11%. Additionally, there were always late fees, even though we paid on time. Finally my husband filed for bankruptcy, and reached a verbal agreement with Ocwen on what our payment would be.But the very next payment was sent back as not being the correct amount, but no one could tell us what that amount should be. We started the very long process of trying to reach someone on the phone who could tell us, with hold times anywhere from 30 minutes to 2+ hours. Many times we were told someone would call, but when 'they' did, it was a recording. Finally we got to talk to 'Ganesh'.We reached an agreement and were told the papers would be sent in the mail, and not to make a payment until we could send it with the new contract. Many calls later, still no papers, but still told not to pay. Foreclosure papers came. More calls, told not to worry, just a formality, don't pay. Second set of foreclosure papers came. Got an attorney. Almost a year later, got the papers, but amount now owed is about $150,000 more than our original mortgage - all sorts of fees and interest due to not paying for a year. We TRIED to pay all year, but were told not to by Ganesh. Amount is more than we could ever hope to refinance, so no hope of getting away from this crazy company even if we can pay the exorbitant amount they demand. After reading all the rip-off reports on them, I don't trust them anyway.We're serious about the class action suit. I've only hit the highlights of our problems with them.

Ocwen Loan Servicing, LLC Ocwen not disclosing where our payments are going, always being told we are 'late' with added fees!

We also refinanced our home with Aegis Mortgage and went through a hardship which caused us to be late on our mortgage. Ocwen began calling and said they were a collection agency for Aegis and we needed to work with them. However, when I called Aegis, they stated they had no knowledge of Ocwen.Soon, we started receiving information that Ocwen was our new mortgage holder. We made a move across the country and have this mortgage in MI and a rental payment at our new home. We fell behind and they started foreclosure. We could not reach any human, and would wait up to 2 hours to be placed with a person who told us he was working in India. After continued calls, we finally reached an American named Kimberly.Kimberly worked with us to set up a restorative program, asked us when our paychecks came in, and then requested several thousand dollars the day BEFORE our paydate! We borrowed from a friend and then sent in the money.Our problems now come from the following:1. We received a notice we'd be getting back $1100 in an escrow overage. When the money was never received, and I called, we were then told an analysis of our account was $7000 NEGATIVE and they were raising our payment from $870 to $1100.2. Our payments, made through Money Gram, never are enough and there are charges and fees that appear on our statement that we cannot get an explanation for and appear to keep mounting.3. We were told by one rep that if they determine we send 'extra money' it is not applied to fees, or charges, but they keep it in a suspension account! There was over $700 in this 'account' by this person's estimate. A later phone call gave us a rep who denied any suspension account exists.4. Now, without explanation, our payment is now listed at $1200 per month!How does one get this type of problem resolved? Who can help?

Ocwen - REO Properties Stole our family home twice Nationwide

I can't help it anymore I have to vent. We have been dealing with this company since 2000 when we bought our home. Our loan was sold to Ocwen and after the first time we were lucky enough to refinance away from them, but unlucky us our refinanced loan was bought again by them several months later. We finally were doing well with our own business and then got ripped off by a family member we were partners with and lost everything. Ocwen made every attempt to take our house including during the bankruptcy we had to file although they were well aware of the situation. Then an attorney for REO Properties/Ocwen got involved (the law offices of les zieve) and they came after us hard even during bankruptcy. They attempted to keep our attorney hopping by filing various paperwork via the courts monthly. The kicker is Ocwen/REO sold our house TWICE within 5 months of each other all of this while they faxed us a loan modification form and accepted monthly payments through both sales. The attorney representing them Lisa cussed me out for questioning this action. Even after the sales they were sending us statements asking us to send payment. WOW. We currently were served with an unlawful detainer by the offices of les zieve although an attorney which we have passed on to our attorney. Our attorney is utterly amazed at what is going on. The kicker...Ocwen has a second attorneys office that is negotiating a remodification with our attorney. They do not know who is in charge at these offices, nor do they care. They put all their mistakes in writing and have no qualms about attempting to kick you out of your home right or wrong. Two days prior to thanksgiving they gave us a copy of the unlawful detainer in front of the kids (the server for process was a jerk). Anyway, we have joined a class action lawsuit against them and I am preparing to send all of this information to the Fair Housing offices and any other congressman or representative that will listen in the states of California and Florida. This company is scary and the information that I have provided is not a joke. I feel as if I am going to have a heart attack at any time. They don't care who they prey on and don't care who they hurt. People fall on hard times as we all can tell in this economy. Can't the government bail regular people out of dealing with OCWEN?

OCWEN LOAN SERVICING, LLC ANYONE FOR A CLASS ACTION SUIT AGAINST OCWEN LOAN SERVICING, LLC ORLANDO Florida

After reading many of the reports filed on this site, it has come to my attention that it is time the home owners should file a class action suit against this company. I too have had the same problems as many of you that have already reported. We were given to Ocwen when Aegis Mortgage Company filed Bankruptcy. We were on a forebearance program and then in November were sent a letter to bring the account current, that we would longer be on the forebearance program. The first certified letter came November 16 with a demand payment by December 16. Then we get a second certified letter dated November 19 with a demand payment for 1/2 the payment of the November 16 letter to be made by December 16. Then we get a third certified Demand letter December 17 demanding payment by January 17 with the same amount of money due (adding $5.21 more to the payment) that was due in the November Letter. We are current with our payments. We have proof of this. So what they are trying to pull, just does not make sense and to reach them by phone is a nightmare. To email them, you are really lucky if you get a reply of which they claim they will replay to you within 15 days. Whoop tee doo!! According to the Govenment Pamphlet on Fair Credit Practices, Section 805, clearly states that frequent calling (of which no one is on the other line either) is a form of Harrassment and is illegal. Well, with reading all the reports that have been given on this web site, maybe it is time that a class action lawsuit be filed to wake the company up. Oh, by the way, when they outsource to third world companies, and then ask for my social security number, are they crazy!!!! There is no way in 'Gods Green Earth' I am going to give anyone outside the United States my Social Security Number. I contacted my attorney and she said we have a great case. Maybe someone should put their money where their mouths are and prove to others that they honor what they say on their Web site. Do I have any takers. I will watch this site daily to see how many people are really serious about starting the procedure. Without you there will be no releif for so many of us and more in the future.

Ocwen Ocwen reporting late to Credit Bureau so no modification to loan?

Ocwen calls me 15- 20 times a day starting with the day loan payment is due until it is paid. Doesn't matter about the grace period. The fact that they start calling me the first of the month and so many times during the day ticks me off. Now when I call for modification they tell me I can afford the payment every month even thous I have sent them all the info they asked for proving I cannot. They are telling me to let it be late and then they can help me after 3 months. I tell them what will you do to my credit and they say it will have to be reported to the Credit Bureau. Today I find out they have reported me late and I have never been late. I want to refinance but now this fictious late payment is keeping me from being able to refinance and get the hell away from them! I would be more than willing to join a class action lawsuit. Besides I am sick and tired of trying to communicate with people who cannot speak English!!!!

OCWEN DISORGANIZED,NO HELP,ADDED FEES ORLANDO Florida

Ocwen-Where do I begin. We started with this company a few years ago and have nothing but frustration and tears. We fell behind one months payment because of medical bills and are now being told that we owe for 3months of mortgage. I have called their 'customer service' line several times to get an answer and have been told that our payments are late and we have accumulated several 'other' fees. We recently had storm damage from IKE and received a check from our insurance company. They had made the check payable to us and our so friendly mortgage company which will now not sign the check due to their added fees and late payments until they are paid in full. That is our money and they have crossed the line. Is there anyone who can help us get out of this nightmare and this horrible mortgage company? They want their money but don't care to help you or keep track of the correct payments. What do these people do with the checks,and why isn't there a class action suite filed against these people,they are messing with a lot of families and people who truly are honest. Where do you find that anymore.

I would like to know what is the latest report on the complains against Ocwen Mortgage Copmpany. I read so many complains posted here on Ripoff, but have not read any results from the complaints.I'm also a victim of Ocwen Mortgage Company...and I truly regret that I refinanced from my previous Mortgage to Aegis Lending. Aegis Lending went bankrupt last year and Ocwen took over. Well, when Ocwen took over, I was told that I was behind my mortgage payment although, it was not my fault that it took Ocwen 3 months to update records from the previous lender (Aegis) yet they count that as being the fault of the borrower. Yes, they have threatened to foreclose my home, but I will not let that happened.I have asked for options and Ocwen put our mortgage loan under a forbearance plan, meaning that payments has increased. In the interim my payments will have covered the previous late payments within a given date. I have hired a company called 'American Forclosure Service' to work with Ocwen in working out a 'Modification Plan' which means to lowering the interest rate of the loan...I've worked with AFS since May 2008 and neither I nor the AFS has received any agreement or approval from Ocwen.I feel that I've exhausted and tried ways to work things out with Ocwen, and my next step is to write to Congress and copy of this letter to my lawyer. Yes, I have records of my monthly payments and other important documents for proof.I feel that as long as I'm under the forbearance plan and paying my mortgage monthly, I have good grounds and evidence.It is going to be a long process...together with lots of prayers and having faith in Our Almighty God...something good will come out of this. Yes, I have setbacks and disappointments with Ocwen, but I feel that I can succeed in spite of this misfortune. The key is having the courage to keep fighting no matter how hard the going gets. He, who falls nine times, but gets up tem times is a success. Success is a journey, not a destination.

OCWEN Mortgage Loan Servicing, LLC RIP OFF SCAM artists

I hate dealing with Ocwen Mortgage. I guess that is a mild understatement. Ocwen bought my mortgage 1 1/2 years ago and it has been nothing but headaches and BS since then. My mortgage has went up twice, without notification and they have messed up my escrow now. We are behind by my choosing, because of the escrow. There is $1024.35 that Ocwen got from us but can't seem to tell us where that money went and/or why. I have done the math and it doesn't work. I changed my insurance company in March to lower my payments. I was paying $4800.00 a year for homeowner's insurance and now I'm paying $2605.00. (Ocwen mailed out payments to both and I am fighting to get the money back from the insurance company that I cancelled with.) Also, my homestead exemption kicked in as of Jan 1st 2008. I called and guess what? They hadn't applied it to my mortgage. I fought like hell to get it in place. (2 months time, BTW.) My payment should have gone down by close to 600.00 a month. But, they called on Friday to inform me now that my mortgage payment has gone up, ironically the exact amount of money that I saved via insurance and taxes to the penny. LOL. Also, to inform me that they don't pay my taxes, although they have for 2 years and it is in my contract that I make one payment, which includes prin+int+ins+taxes. They state that they have paid my taxes to date simply as a courtesy. LOL. A courtesy? How about this, per my contract? They did not have the original contract in front of them and the girl tried to start bullying me. LOL. I don't bully easily. It's simply not worth it to me. Now they have called 26 times since July the 1st and 50% of the time when they hear my voice they hang up. You can hear the typing in the background. LOL. They did call and asked for my husband, and he says 'My wife handles all of the finances.' I kept them on the phone for 49 minutes yelling at them and asking them to get it together. That was pointless. Here is the other funny thing, I am NOT on the loan, I am strictly on the title. Yet, they report it late on MY credit. ILLEGAL!!!! I did not sign, not one document in regards to the loan, my husband did. I have spent so many hours dealing with them and have yet to speak to the same person twice. There is always a different story. I refuse to submit to them and I refuse to allow myself to be ripped off any longer. I am trying to find an attorney who will help start a class action suit. It seems that this needs to be done. Although after much research I realize that the courts usually side with Ocwen. Ocwen makes sure that the venues get changed to where there are more favorable judges (my guess judges that own stock or being paid on the side, it's sad but this is our country.) I have resolved myself to letting go of the property and letting them lose money on their investment. Currently, we owe $326,000. The house is valued at $250,000 in this market. My husband and myself have realized that the stress from dealing with Ocwen isn't worth our health or happiness. Quite honestly, it pleases me to no end that they will lose money in excess amounts. LOL. I have gotten to the point where I actually make fun of the people when they call me. LOL. I know it sounds childish but when you are dealing with them and can't get a straight answer or speak to somebody that speaks ENGLISH, I'm kind of left with little else, except wait for them to foreclose. Which I am doing. I love my house very much but not at the expense of my family. Ocwen's stock has been on a steady decline for about a year and a half. Sound familiar? That was when they took over my loan. My advice to all or some, is simply this: let go. Let Ocwen suffer the loses. I have given up on the fact they will help the situation or fix their problems and I'm NOT going to pay them another red cent. They can kiss my a**. :-) I believe in a matter of time the government will step in and Ocwen will lose their a**es. I will try and find an attorney in the meantime to try and help us out of this pickle, even bankruptcy. If and when I find an attorney that is willing to help ALL of us out and away from Ocwen, I will post his/her name for all of you and every site that I can. I would rather an attorney make money than them. If any of you get an attorney that is willing to handle this, please post their name for others. I wish you all well and hope that you all get away from Ocwen. I read that somebody called them The Mortgage Mafia. LOL. How true. Remember this, it's just a house. It's not worth you or your happiness or your family's health or happiness. It is simply a material possession that can be replaced. Let Ocwen suffer the losses, not you. Life sucks as it is right now don't let them make it worse. Take Care.

Ocwen Federal Bank Has The Federal Courts stepped In ???

Like many of the truly horrific stories on here, My Wife and I have been battling Ocwen for pretty mcuh 6 years since they bought our mortgage.
false paperwork..not crediting monies..finally we did the bankrupcy thing to save our house(we have 5 kids)
Our attorney has filed suite against Ocwen for only one of the many things they have done. Hopefully we have been trying to refinance our mortgage with someone else. Our attorney told us that since Ocwen has so many lawsuite against them that they are putting all the cases in some sort of pool. In one location appparently
Does anyone have information on this...The other question that bothers me is if so many people - GOOD FAMILYS - why isn't nnyone on a government level doing anything about it.
If you or I got caught in grand theft we would go to jail. In most states the 3rd time you go for life...WHY ISN'T ANYONE DOING ANYTHING.
I read on here some people having problems ...get an attorney now...today...don't wait...Do not send money to one of those Stop the sale people....they are in bed with Ocwen.

Ocwen Federal Savings Bank Ocwen Stole my home ofter 16 years

As stated to many officials, attorneys, help agencies; Ocwen Stole my home!In March of 2003, after reinstating a new forebearence agreement and payment made, Ocwen took me to court and within 3 weeks, I was ordered to move.
I was taken by legal persons who stood before the judge with me, I never got Legal Assistance help which one of the judges referred me too. I got help, but Ocwen lied to them and wouldn't cooperate. I can't tell it all, but I have every document. I have been homeless, embarrassed, devistated, and overwelmed by representatives who offered to be the peoples support and allowed these thevies to do this. Now in 2008, homes are being loss daily. I believe that God is using me, because my home was a blessing from him. I've learned a lot, but until Ocwen answers; I'll never be complete. I feel for everyone who has endured their evil, but as God gives me strength--we'll all be blessed. If you want details, I have them.

Ocwen Loan Servicing Mortgage Fraud equals Ocwen

Ocwen has been my loan servicer for my home loan since 1998. Over that time, I have had numerous foreclosurer notices and even had to obtain attorneys in fighting them. Ocwen does not record payments made and issues statements that are in conflict with each other. In 2002 my attorney spelled out in 33 points, exactly the same points that are included in the Class Action Law Suit that is occuring in the state of Illinois, I have a court stamped document to testify to this. Even the court document did not change their practices of charging large fees and expenses, not crediting payments and charging for insurance even after I have faxed them copies of my insurance declaration sheet. The service representatives are always ready to create forebearance plans that, in my case, reached an extra $300.00 more per month. Even, if I made the payments in a timely fashion, for some reason they were never credited on time to my account. When I made the forebearance down payment, which always consisted of $3,000.00 or more, I was never given statements to where this monies had gone. In 2006, I received a short statement of fees that they were going to waive, totaling of approximately $12,000.00 This was never credited to my account. Why wasn't this applied to my loan? Over the years, I have asked for statements,either on the phone, or on the internet and never received them. In fact, I sent one letter to an attorney in Cleveland Ohio who represents Ocwen for a complete accounting of my loan. That was in 2005 and I have never received it. At the end of 2007 after payments that were never credited to my account, they wanted to put me back on another forebearance plan, after about 3 or theses, I did not want to be put back on another one. They wanted to raise my payments. Also, Ocwen would make promises that if I would make 12 payments on time that I would be taken off the foreclosrer /forebearance status and that when I signed up for the forebearance that it would be reported to the credut bureau as paid up to date. This never happened. The 12 months came and gone and nothing, during that time was changed. In 2008, Ocwen decided to offer me a modification plan. The plan looked like a dream come true, but when I asked questions ie if I would be charged expenses at the end of the loan? How much would my payoff be if I sold the home? and if there would be early payment fees applied, they could not give me an answer. I made numerous calls and was put on hold for up to 2 hours, and when someone did try to help me, I had numerous different answers. I even wrote the ombudsman and still did not receive the answers to my questions, they would beat around the bush about the questions. I needed answers in writing before I would sign. They offered me another modification in May and again the same thing happened. I did not sign. In the meantime foreclosurer papers came, The Bank of New York as successors to Chase Bank was the loan owner on the lawsuit. I called both of these and even Chase Subprime loans and all stated that they had no interest in my house. Who is the 'party of interest' OF my loan? I still do not have a real answer Ocwen did not answer this for me and neither did the their attorneys in this case Today, July 28, 2008, my home of 24 years was sold at a sheriffs sale. This Is FRAUDULENT I have filed a complaint with my states Attorney Generals office and with the Fair Trade Commision in Washington DC. I have discoved the Class Action Law Suit that is taking place in Illinois and have written that attorneys office. I will be obtaining an attorney for my individual lawsuit. I am not going to stop fighting until Ocwens doors are shut. They are predators and they need to be stopped from their deceptive practices. I may lose my home because of them, but I think they will lose their business also. Have you noticed their stocks are going down and their business is dropping. Maybe a Large Class Action will finish them. What a shame that companies like theirs exit. Maybe if it wasn't for their dishonest ways, the housing market would not be plunging and banks would not be closing their doors. Most of us who are subprime did not cause the problems, companies like Ocwen has. Their main customer relations department is in India, could that be the reason communication problems existed at times Why as the United States of America, are we shipping our business out of our own country? I wonder if its the number from India who calls me, sometimes up to 4 times daily and as soon as I answer it hangs up? I call this harrasment.

Ocwen Loan Servicing LLC Ocwen Mortgage Company- Orlando Florida- Are riping homeowners off- This must stop now Orlando Florida

I see that I am not the only person who is being rip - off by Ocwen. What I don't understand is how Ocwen is getting away with so much? I have had Ocwen since May of 2006. How they came to acquire my loan is still a mystery.
In December of 2005 I refinanced with Quick Loan Funding based here in California. Before my loan finished escrow they sold my loan to Option One. Some how in May of 2006 Ocwen was servicing my loan. They still claim to this day that Quick Loan Funding is who they are servicing my loan to. I told them that Quick Loan funding went out of business here in California March of 2007. Ocwen also has never been on my Title. I can't sell my house because there is no proof of a lender. Ocwen has refused to send proof of who they are paying my mortgage to.
On February 3rd 2008 I filed with Ocwen a loan modification. I had to hire an lawyer because Ocwen never returned any of my calls because I was not in foreclosure. They said I had to be in foreclosure before they would do a modification and that I would have to pay 5,000 to do the paper work. It has been five months. My lawyer has filed several papers with them, they claimed they did not know I had a lawyer, they claim that the papers that my lawyer faxes them, they cannot read.
I had to sell one of cars just to keep my payments current because my daughter and I are on a fixed income. In October I will start falling behind in my payments. This is what they are waiting on. Hoping I will fall behind so they can charge outrageous fees and take my house. All of this could of been avoided.
I cannot understand why when you talk to someone in Ocwen they are always in India. A person you cannot understand.
I don't know what I am going to do come October. Ocwen does not know who they are servicing my loan to, so who have they been paying for almost three years? And if they don't know who my lender is, how can they claim that they can do a modification?
On their recorded message they state; ' we are a debt collector not a mortgage company.' So what gives them the right to say what happens to my mortgage if they do not know who my lender is?
They claim that what I filed with them in February was to old, but my lawyer sent them another modification in May. Now they told me yesterday that the one in February, that I was in to much debt, but they called back and said that they could modify my loan if I did not state my debt? Just put that I owe on my mortgage, and that I do not pay anything else? Isn't that illegal?
These people are hurting thousands of homeowners, they don't know who the so called investors are, they charge fees just to send a paper that is suppose to be free. I had written a letter to all of the C.E.O.'s of Ocwen today, if they do not respond then I hope by the grace of God I can find a lawyer before October to take my case, or my daughter and I will loose our home.
Ocwen told me today that they did not want my home, but yet they play terrible games with the homeowners. Most of their representatives you cannot understand because they barely speak English. I had read many stories about Ocwen, I am going through a horror story my self here in California.

This company contacted me about 'lowering the interest rate on my elderly mother's loan'. When I received the paperwork it was for a 'loan modification that put the loan in a forebearance status'. My attorney advised against that and I responded in writing that we did not agree with or accept the 'modification documents'. I have made 17 phone calls and spoke with people who give false names in every department. They have charged fees and still show that the loan is in a forebearance modification when it IS NOT and the payments have all been up to date.
In addition, I get phone calls on my cell phone still asking for me to return paperwork from January for a modification that the 'modification department' says is not approved because the lender WILL NOT ALLOW a modification. Go figure. I have all these phone calls documented with dates and names. I have spoke with the Florida Department of Consumer Affairs and was told that they have numerous complaints against Ocwen.
The only way to keep the loan out of their default status is to pay the fees they attach. They will not give me the contact name of the bank that underwrites the loan, I get transfered, put on hold, transfered, put on hold, only to speak with more people who I can't understand. The only success I had was to get one lat fee adjusted after threatening to contact the media.
This loan was originally with Country Wide and was sold to Ocwen, and then sold again. My father passed away last year and I am trying to help my 85 year old mother NOT LOOSE her home.
Todate, after hours of phone calls and thousands of dollars, I still don't have proper information and can't get Ocwen to help.
In addition, in May of 2007 when my father was ill and passed away, they sent a 'forebearance notice' to their home - instead of the proper mailing address which was on file. They tacked on thousands of dollars of fees and attorney fees, would not work with my attorney, and then when we paid 11,000.00 to bring it up to date, they told us we would have to pay another $3,000.00 in fees. We paid $13,000.00 to keep the house out of foreclosure when it was 3 months behind, because they would not work with my elderly mother but demanded money.
SOMEONE WITH POWER TO HELP - LIKE NEWS WATCH 8 NEEDS TO INVESTIGATE THIS COMPANY. THERE ARE HUNDREDS OF COMPLAINTS ON THE INTERNET AGAINST THIS COMPANY.

03/94 I entered into a forbearance agreement with HUD. I was convinced by HUD and Lincoln Service Corp. that this was necessary. I was very confused why this was needed. The forbearance agreement would save me $18.35 per month and increase my purchase price from $42,900.00 to $43,000.00.

04/98 Began receiving letters from Ocwen stating my loan was in default and they would attempt to collect the entire amount of the loan. I was not behind on any payments when the collections letters began. At this time, I began sending all payments through Western Union-Quick Collect so I would have documentation of payments made and received.
02/03/99Received Notice of Acceleration from Ocwen, demanding entire amount of $56,927.58 in full. Called the 1-800# provided in the letters, customer service, all they would tell me is the entire amount would need paid or they would foreclose. It took several phone calls to many numbers before someone agreed that only my regular payment was due, not the entire amount. Was informed the demand for payment in full was a computer generated letter sent to all customers. I consulted attorneys to assist in the threats they were making to take my home. The attorneys all wanted $1000.00 - $2000.00 up front with no guarantee. I did not have that kind of money and was afraid Ocwen would take my home.
05/04/99 Received another Notice of Acceleration from Ocwen, now demanding $57,040.08 in full. Again, I called many times before I could speak to someone who explained that only my monthly payments were required. I was not behind in payments when I received this notice.
06/11/99 Received a notice that July 1999 payment amount would be $15,670.19.Called, again I was told that this was a routine mailing, nothing to worry about, just continue making my regular monthly payment.
06/25/99 Ocwen's attorneys filed a suit against me; summons delivered in person on July 1st, demanding payment in full, $41,741.66 on principle and stating foreclosure of property.
07/01/99 Ocwen returned my June and July payments - $772.00.
07/99 Received letters from Ocwen demanding different amounts be paid or they would foreclose, one amount - $16,303.08. Several letters on their letterhead were not signed.
08/02/99 Ocwen returned my August payment - $572.00.
08/04/99 Tried again to find an attorney, with my limited resources. I could not find an attorney that understood the situation or was comfortable suing a bank. I sent a letter to Ocwen stating I was countersuing, claiming wrongful foreclosure, stating they had returned 3 payments in a row to purposely file foreclosure.
08/11/99 I sent a letter to Ocwen requesting information;When did my loan change from 9% to 10%, why and why wasn't I notified? Requested amortization statement, had never received one from Ocwen.. I wanted to know the exact application of my monthly payments.Information returned; 08/01/97 04/22/99 only $462.00 went to principle.
08/99 New forbearance agreement entered with Ocwen. They agreed to put back interest that accumulated, while HUD had my mortgage, to the rear of the loan, which made me current. They will accept my monthly payment and suits against each other would be canceled. I did not know until this time that the forbearance agreement with HUD was so damaging, that none of the money I paid HUD, $15,525.00, went toward my mortgage.
09/99 Ocwen again sent back my monthly payment, $400.00.
11/99 Ocwen sent me another letter of acceleration demanding; $19,650.00. After the above arrangements were made and they convinced me everything would be fine, I would not lose my home, they again began sending letters demanding huge amounts or I would lose my home.
12/01/99 Filed Chapter 13 to save my home. Payments of $250.00 made to; Terry Smith, Clerk of Court, Tampa, FL.
07/31/00 Chapter 13 hearing, resume payments to Ocwen, per court order.
09/12/00 Ocwen sent an acceleration notice, full amount due - $67,286.65.
10/04/00 Ocwen filed for mediation to resolve differences. I appeared as directed, no representative of Ocwen present. The hearing officer reschedule, again I attended but no one from Ocwen attended. The hearing officer dismissed the mediation, failure to attend by filing party, Ocwen.
10/13/00 Received new forbearance agreement from Ocwen stating $1000.00 down and monthly payments of $517.00 per month.
03/22/01 Court dismissed Chapter 13.
06/30/01 Met with manager of Bank of America to refinance my home and get away from Ocwen.Ocwen refused to cooperate and would not sell my mortgage to my bank.
09/21/01 Notice of intent to terminate forbearance agreement received from Ocwen, amount due,$6239.53.
11/09/01 Ocwen again filed foreclosure on my home demanding; $65,901.38.
12/06/01 Received another letter from Ocwen now demanding; $6952.68.
12/07/01 Filed another Chapter 13 to save my home. Again I could not afford an attorney to assist me with problems by this mortgage company. The attorneys I spoke to did not understand HUD purchased houses or what Ocwen was wrongfully doing.
07/09/02 Ocwen attempted to convince me to cancel the Chapter 13 and reinstate a forbearance agreement again. I refused because they had lied so many times and I did not trust them. Somehow, they convinced the court that they had the right to foreclose and the foreclosure sale of my home was scheduled.
08/02 I contacted an attorney to handle a Chapter 7, my 13 was converted to a Chapter 7.
They would not assist me with anything prior to the Chapter 7 because they would be entering after the fact and for liability reasons could not be involved with the circumstances of the past two years. In Florida you can keep your home when filing a Chapter 7, but since Ocwen prevented me from making payments, I was behind and did not qualify, and would lose my home.
05/03 Phone hearing to resolve Chapter 7 took place. Chapter 7 discharge set for June 2003.
09/03 Contacted the courts for copies of my discharge documents. It was not filed in June as scheduled, but they would file it now.
03/04 Received notification from Ocwen, stating the outstanding balance on my home of $41,268.77 is resolved with the Chapter 7 and fair market vale is $60,000.00. I was not provided a penny of equity even though I made 10 years of payments on my home.
All the stress and worry during the time Ocwen took over my mortgage caused problems in other areas of my life. I lost a lot of time from work for court appearances, etc. I worked for the State of Florida. I was terminated from my 15 year career job.
Ocwen stole my house from me after 10 years in my home. They caused me to lose my career job of 15 years, they ruined my credit and left me with nothing.
I am very interested in suing Ocwen for the damages they have caused me, loss of my home, my career & benefits lost. Ocwen should be held accountable for the damages they have caused us home owners. Several home owners only had a one time shot at home ownership and Ocwen ruined them for life. Thank you for listening.

I entered into my second month of delinquency I was able to get a money order in the mail to Ocwen and it was sent back to me stapled to a financial report demanding that I complete this form so I did and at the same time I was called and asked a million questions over the telephone and was told oh you can afford a much higher mortgage payment I can complete a foreberance for you with an escrow and at the end of the 12 month foreberance you mortgage payment will reduce back to the original amount and you will have cash in you escrow. So I went for it and noticed after I paid 2500.00 down on this foreberance I still continued to get statements with late fees, attorney's fees, search title fees and the list goes on and I checked the bureau and my payment history was a mess I was reported over 30. 60. and 90 days late on my moetgage history so I called Ocwen only to get someone I could not understand there was a language barrier and he would not put anyone else on the telephone. I CALLED BACK AND GOT SOMEONE TO TELL me a mass of lies. after the 12 month foreberance period I was sent another financial form to be completed and 2 options, a repayment plan or listing my property for sale consequences loss of prperty, Damaged credit rating, deficiency liability, and tax ramifications. I was never given an answer as to where all my extra money went Ocwen could not produce a itimized bill and to this date Ocwen is trying to raise my mortgage payment again and force me to complete another financial report what can I do they has scared my credit and lowered my scores to the point were I cannot get a refi nor a new mortgage therefore i'm stuck with no way out what can a man do when he is striped of all his rights and dignity.

Ocwen Loan Servicing LLC Bogus Charges, 'Funny Math', Misapplication of Payments, Offshore Customer Service

My Ocwen loan is a 2nd mortgage. I financed my home with an 80/20 fixed rate mortage in 2005. The original loans were through Long Beach Mortgage, who then sold them to Washington Mutual. WaMu in turn sold the smaller $25,000 loan to Ocwen. I missed 2 payments to Ocwen in April and May of 2007. In June of 2007 I enrolled the loan into WaMu's Equity Accelerator Program. Ocwen has been receiving approximately $19 a month above and beyond the amount of my monthly payment since June of 2007, which has not been applied either to the past due balance or to additional principal. Instead, it is sitting in 'suspense' until such time that (so I was told today by the customer service representative in India, and her supervisor, also in India) the amount in suspense is equal to 1 monthly payment, then they will apply it to the current month's payment. While my statements reflect that I have a past due balance of approximately $450, my current payments have steadily decreased to the point where my statment reflects that my current balance for April (not including the $450 past due) is less than $50. Moreover, they are charging late fees and 'miscellaneous' fees. When I inquired regarding the miscellaneous fees, I was told that I was being charged approximately $90 for 3 'drive-by' inspections of my property that occured in August, October, and December of 2007 by 'someone in Ocwen Property Protection.' I insisted on the name of the company, written reports, etc. and stated that I would not be paying for property inspections that I neither requested nor was made aware of.Ocwen recently me sent correspondence giving me the opportunity to enter into a loan modification, whereby I would pay a certain sum of money now, and for the next 3 yrs my interest rate would drop down to almost 4%, and my payments would be almost 1/2 of what they are currently. The modification agreement states that 'you agree... that the unpaid principal balance is...' a figure in excess of the original $25,000 loan I took out when I purchased the property in 2005. Whereas my principal has dropped on my 1st mortgage (the Wamu Loan) from $101,000 to $98,000 in the last couple years, Ocwen wants me to believe that my principal on their loan has only dropped a couple of hundred dollars over the same time period; moreover, they want me to agree (in the form of a loan modification) that the 'modified' unpaid principal balance will be more than the original principal balance that I started off with. I had a real estate lawyer to read it over, and he says in addition to that, the agreement states that I waive alot of rights, including 'any expenses incurred in connection with the servicing of your loan, but not yet charged to your account...are not included in the Unpaid Principal Balance and may be charged to your account after the date of this Agreement.'Funny math, non-American customer service agents, charges for inspections which I had no knowledge of and did not consent to...I intend to write them a letter and follow up with letters to the Attorneys General of Florida and Texas. If there is a class action suit going on somewhere that I can opt in on, please contact me.

Ocwen Finacial, REPORTING LATE PAYMENTS 7 TIMES. WANTS $4000.00 TO CATCH UP OUR LOAN. WE ARE NOT BEHIND

We have been with Ocwen for a year and a half. We had a miss hap with a pipe under our garage floor that broke due to a freeze we had that year ( 2006 ). So we got behind, our family gave us some money to help catch up and so we had one more payment to pay and Ocwen told us about a forebearance program. So ocwen told us they would spread out one payment for six months and I told them to send me the paper work so we could look it over and decide from there if we would do it or not. Well they started to send statements saying that our new payment was $2677.58 from $2400.00 a month. Because we were on a fix interest only lock in for 2 yrs loan I decided to look in on a fix 30yr loan sense the interest rate were going down. So I started looking at other companies and found out through them that my credit scores are at 545 and I have 7 late payments on my credit. So I called the Ocwen comp. and asked them why they reported me late on my payments and the man I spoke to said that the forebearance plan is why they had to report me late. I have not been late for the seven month that I have had my mortgage go up $277.00 more a month. Plus the man said that I have been charged late fees of $112.00 each of those months that I was not late. I ask him what it would take to get off the forebearance plan, I would have to come up with the $4000.00 to catch up. Then I asked if thier was a signature on the forbearance statement and they told me that it was a verbal agreement. I never agreed to have my credit messed up and reported late every month for the last 7 months so I cant get my house refinanced to a lower payment. Now Ocwen said as of April 1st that my interest rates will be raised to 10.375% on this interest only loan and that my mortgage will be raise to $3151.58 a month so I guess like everybody else that has been in their grip I'll loose my house too. Plus when they took over my loan with countrywide they raise the interest rate from 7.5% to 8.375% even though I was lock in for two years at 7.5%. The man on the phone told me when they bought our note that it raise up to 8.375% because that is what it was at the time when they bought the loan. I did not sign for the 8.375%. and that they are charging us $12.95 for some insurance that I had know idea what that was and that I was going to be charged for the phone call I placed to him to find out why I was being recorded as late? I need this to go out to all that are suffering from this Ocwen and if there is someone in Arizona that has a lawyer and needs more to join there lawsuit I'm in. I need some help to get mine and my husbands life back on track and get our credit back to normal and get these people shut down beefore there are more lives destroyed by the fraud of this company.Lauragilbert, ArizonaU.S.A.
