What is being done about Ocwen is what I want to know. I am contacting my State Credit Commissioner and filing a complaint, they have run me into an 8K negative and misapplied some of my payments so they are showing me past due and I have made every single payment on time every single month. Rip OFF artists! No wonder they have so many REOs listed on their web site. I have asked customer service for a copy of their payment history to find out where they applied my payments for two years and to this day, they have sent me nothing, Can the do this?

Ocwen Loan Servicing , Ocwen Financial A Nightmare Orlando Florida

In August 2006 my Mortgage was transfered to Ocwen Bank. Almost from day one Ocwen has been posting late charges for payments that I made on time. My payments are due on the 1st of each month with a 15 day grace. In one instance they sent me a letter for insufficient funds on an automatic debit. Ocwen was suppose to ACH a payment of $1020. Instead they debited $1123. Ocwen, without authorization added hazard insurance charges and a home warranty service. I'm in the tank for $3000 and I never missed a payment. I am getting default letters weekly but conversly Ocwen has never refused a payment. When I call Ocwen all I get is lip service from someone that doesn't understand english. On 1/23/08 I sent Ocwen a certified letter (return receipt)disputing the late charges together with a request for validation of the debt. I Received the return receipt un-signed. Here is the kicker!! My home owners insurance and property taxes are escrowed. I received a notice from the city that my 2007 property taxes are delinqent in the amount of $1600. A 1098 that I received from Ocwen stated that they paid $1722 in 2007 taxes from Escrow. Not only did they not pay my taxes , the 1098 stated they paid more taxes than was due. I would certainly apreciate a referral to a competant attorney to help me solve this problem.Edhuber Hts, OhioU.S.A.

We had bought our home 2 years ago and guess who the lender was OCWEN, well we were exicted to be home owners. The first year was fine, no problemes at all, other then the constant calling when it cam past the due date, but yet you had your grace period.Well Christmas of the next year we mad that payment late, that is where it all went down hill. We had gotten multiple foreclosure letters in the mail and phone calls. My husband and being new at this called them up to see what the problem was. Oh my god they said that we need to pay 1,200.00 to get caugt up and they can arrange a forebearance plan for us to get caught up. We first had to send them 436.oo to start the plan. Well we did.We then got these papers in that said we would be on it for 6 months and have to pay 600.00 wchich is 200 more then normal. So we did that for the 6 months and I then called them up to see if the payment would be back to normal?????Guess what, I think not they said we are not caught up yet, we would have to extend it for 4 months yet..The whole time I am looking at our monthly statements and there are all of these charges that are Misc, ask them what they are and they don't have a clue.Where did all that extra money we were paying go to..They don't know!!!They reported us as being 90 days late even though we were not..They SUCK SO bad, when you go to the web site to leave comments and stuff, you get a crappy computer generated respones sent back to you..We have tried to refinance but can't because of them, they finally sent us a letter stating that we are no longer in forbearance, but on my statments it said that payments have changed and could reflect on your forebearnace plan.WHAT THE HELL DOES THAT MEAN????idiots complete and udder axxholes is the proper word.If anyone has any info on refi please let me know, Iwould be so grateful....BoopFreeland, PennsylvaniaU.S.A.

Ocwen IS A MONSTER WE NEED TO FILE SUITS NOW TO PUT THEM OUT OF BUSINESS! Orlando Florida

Folks, look at what this company is doing. Horror story after horror story! It is time we banded together somehow and filed a class action suit against these clowns. Especially now, during this political year where 'subprime, predatory lending' is part of the political hot-topics. Especially now, since the subprime crisis in this country has finally opened the ears of legislatures.
For YEARS, Ocwen has been destroying people's lives. It is part of their business plan. Look, right here, on this website alone, we have over 1300 horror stories. What percentage of Ocwen's total customer base do you think that comprises? And what about the thousands of individuals who have been ruined but who haven't come to this site.
I am willing to join ANY legal action against Ocwen. ANYthing!!
They attacked me about 5 years ago. I had refinanced my home in April. Two months later, the lending institution sold the loan to Ocwen. And immediately, the nightmare began. False reporting, service reps living in India taking my calls...and hanging up on me as a regular protocol. I paid on the first of every month beginning the very month Ocwen notified me that they were the new servicers of my loan. 6 months later, it was brought to may attention that they had been reporting the loan deliquent 90 days EVERY MONTH SINCE THEY TOOK IT OVER!! My credit went from 700-someting to the mid-500's. My house started getting threatened with foreclosure!
One day, one of the reps from India called me up at 5 pm and said, 'If you don't pay $8000 by tonight, we are going to foreclose on you.' I panicked! It was too late to go to the bank, but I figured I could do it the next day. He said 'No.' As I was trying to explain the TIME DIFFERENCE to him, he hung up. I called back all night long..and he or other reps kept hanging up on me.
The next day, in an absolute panic, I went to the bank, got $8000, and sent it to them in a Moneygram (the only type of payment they will accept when you're 'delinquent,' by the way).
The nightmare continued long long long after that. For two full years! I finally got a company who understood Ocwen's tactics to refinance me the hell out of there!
But their service and the trauma they put me through I have never forgot.
If there is a lawsuit out there, I will join! I will START one if a lawyer contacts me.
Ocwen needs to be put out of business! They need to be made Public Enemy #1 and ridiculed on the front of every magazine.
Look what a group of New York Legislatures did to Signature Compounding Pharmacy. When the Steroid scare in the major leagues became a household buzzword, these legislatures went into Florida and all but burned Signature to the ground. They have the power to do so. We need to get them doing that to Ocwen. This company has to be made an example of, an example that says, 'THIS IS AMERICA! And the minute it becomes your business practice to harass and terrorize our citizens, your business is going to be hammered into complete non-existence.
I am in! Just lead me in the right direction.

I started in early 2007 to try and get help with my loan. My spouse lost his job and I was diagnosed with cancer. I called the HOPE line and the deal they worked out with OCWEN still was too much money in a lump sum. I found an investor who was willing to pay what they have listed as the FMV on my 1099A. They were so diffcult to get int touch with and it seemed that we kept resending the same papers every two weeks. Finally the date of auction fast approached. Sale was set for Nov 15th. My investor grew tired but kept on trying. Fearful of being without a home, one week before the sale we moved out. I had enough. My investor tried up to day of auction to get his offer accepted. They just wanted more of the same paperwork resent. Auction came and went. I just got in the mail a 1099 A from OCWEN. The Principal and FMV are the difference of my second note. I have tried to call to see if I am getting a 1099 A for the second note...of course, the lines are all busy, my wait time is 2 hrs . They said I can set up an appt. I tried that and the phone keeps getting disconnected. I have had enough of these people. They got a home in much better condition than when I bought it.What more do they want?????I barely make enough to pay the bills now. So when I file my taxes I guess the 79K profit they list on my 1099 A is my problem with the IRS. Thanks OCWEN for nothing!!!DebbieColton, CaliforniaU.S.A.

My Husband and I also have lost our home to Ocwen. Our mortage was sold to them in Nov. 2005 and in Feb. 2006.They said we were behind and they were going to foreclose on us in May of 2006 so we filed Chapter 13 to keep our house and had the payments sent directly to them directly through the court so they couldn't lie about the payments. they increased our mortage 2 times with out notifing us and therefore show us behind even in chapter 13then in august 2007 my husband had a stroke and I could no longer make the 13 payments so we had no choice but to go chapter 7 and move. Now ocwen is still sending us statements saying we owe $7,000 dollars to them in legal fees and won't do anything with the property. I had a buyer for the property even after we lost it and they won't sell. I don't know if we even could do a class action suit now but I do know you all should persue it because they will rip you off and you will end up like us filing bankrupcky just to keep a home that in the end you will owe more for and will never pay off.
Help! I am experiencing a nightmare w/ Ocwen. It's the worst customer service I have ever experienced in 55 years. They promised to help me save my home w/ an ever rising ARM using a loan modification several months ago. Nodody answers their phone EVER...3-4 hours wait time on hold, losing documents, language barriers from their outsourced help in India. Please advise of any class action lawsuits...they lie and mislead just to get you off the phone and my home is in huge jeopardy because I took their very INCORRECT ADVICE. Ocwen help ocwen is ruthless Orlando Florida

Started in march of 2007 payment we made was reported late when in fact ocwen posted to another acc. took ten calls and over 40 hours to reach them ocwen fixed it but still posted on our credit that the payment was late. In the months of November and December of '07 we were behind in our payments due to medical reasons this being our first time ever to be late. OCWEN sent a notice of default the 24th of December saying I had to pay the past due amount 1085.06 by January 17, 08 Dec 28, 07 received a letter stating a interest rate freeze if I sent 1110.58 by December 31, 07 which I did by overnight mail. I was all current as I thought when I received a letter January 7, 08 stating ocwen did not received in it there within a specified time frame but they cashed the check and posted it December 31, 07 OCWEN said they were going to send the signed agreement with the check back to me which they have not nor posted to the acc correctly. I was sent four different acct statements with different amounts to pay. I finally got though to them and Ocwen stated they receive nothing and told me that January payment would go to fees that we owed but would not tell me how much. There is much more to the story but I am now trying to work with our fair housing to get results.I would love to be involved in a class action lawsuitRecardotoledo, OhioU.S.A.

I was all current as I thought when I received a letter January 7, 08 stating ocwen did not received in it there within a specified time frame but they cashed the check and posted it December 31, 07 OCWEN said they were going to send the signed agreement with the check back to me which they have not nor posted to the acc correctly. I was sent four different acct statements with different amounts to pay. I finally got though to them and Ocwen stated they receive nothing and told me that January payment would go to fees that we owed but would not tell me how much. There is much more to the story but I am now trying to work with our fair housing to get results.I would love to be involved in a class action lawsuitRecardotoledo, OhioU.S.A.

I have been receiving collection phone calls from OCWEN Aukland they are stating I owe HSBC Platinum investments 500 plus dollars. I checked my credit report and there is nothing on this report that would indicate this debt owed I stated twice the confirmation number and told them to write me no call also my phone number is registered in my wife's name ( foreign immigrant)This has been going on for 2-3 months I have demanded they write me not call me they refuse and I demanded they appear in U.S. Federal court they refuse. I demanded OCWEN Auklands physical address they refuse. I was on the phone for an hour an half trying to get though to make a payment to ocwen and was not able to so i got on the computer to try to do it that way and that is when i came across this great web to let me know iam not alone.I AM TRULY SORRY TO ALL OF THEESE FAMILY OUT THERE THAT OCWEN HAS DONE THIS TOO. BUT IAM ALSO GLAD TO SEE IAM NOT ALONE.They will call my house and i think oh good someone is calling i can actully get to talk to someone to find out it is just a record telling me to call them. And i have tryed to call them many many times there is always a wait along wait 1 hour or longer the one time i tryed to call my wait time was over 1 million minutes (no lie )now how is that possible. to get into the fee they have charge to stop the foreclouse on my home .i wont know where to begain my huband and i have owed our home for 12years with no problem ,unit we refinced to try and save a few buck with first federal mortgages and they sold it what ever they do to ocwen. Ocwen Loan Servicing These people are a nightmare. I actually declared Chapter 12 to force them to lower my mortgage interest rate. They have not complied with the bankruptcy order even though I have made all of my payments on time. They applied one of my payments to bogus fees and are intentionally reporting me late to the credit bureaus. This has made it impossible for me to refinance. ate Orlando Florida

Ocwen bought my mortgage from Metwest and trouble began. I had a high mortgage interest rate and tried to negotiate a lower one with them. This was not possible so I had problems keeping up with the payments. Anything to do with Ocwen is grissly so I filed Chapter 12 to make them lower my mortgage interest rate. They were forced to lower the rate but did not comply with the bankruptcy order. I have made all of the new payments on time but they refused to recognize the stipulated order. I hired a lawyer to write them and send the info ordered by the court. This was one year later from the order and they had continued to report negative info to the credit bureaus even though I had made all of my new payments on time. They decided to update my account at my lawyers request and decided to apply one of my payments to some of their fabricated fees and bogus charges. So now this shows me to be late one payment. They continue to send negative info to the credit bureaus and have made it impossible for me to refinance. I contacted the ombudsman department and they were no help at all saying that what Ocwen was doing was justified. These people are criminal and they should not get away with it. So I have hired another lawyer who specializes in personal injury and consumer complaints to file a suit against Ocwen for all of the damages they have caused to me and my credit rating. I think the class action suit is warranted as Ocwen needs to be taken down or destroyed like the lives they continue to ruin with their arrogant greed.LesaTucumcari, New MexicoU.S.A.

After reading many of the reports filed on this site, it has come to my attention that it is time the home owners should file a class action suit against this company. I too have had the same problems as many of you that have already reported. We were given to Ocwen when Aegis Mortgage Company filed Bankruptcy. We were on a forebearance program and then in November were sent a letter to bring the account current, that we would longer be on the forebearance program. The first certified letter came November 16 with a demand payment by December 16. Then we get a second certified letter dated November 19 with a demand payment for 1/2 the payment of the November 16 letter to be made by December 16. Then we get a third certified Demand letter December 17 demanding payment by January 17 with the same amount of money due (adding $5.21 more to the payment) that was due in the November Letter. We are current with our payments. We have proof of this. So what they are trying to pull, just does not make sense and to reach them by phone is a nightmare. To email them, you are really lucky if you get a reply of which they claim they will replay to you within 15 days. Whoop tee doo!! According to the Govenment Pamphlet on Fair Credit Practices, Section 805, clearly states that frequent calling (of which no one is on the other line either) is a form of Harrassment and is illegal. Well, with reading all the reports that have been given on this web site, maybe it is time that a class action lawsuit be filed to wake the company up. Oh, by the way, when they outsource to third world companies, and then ask for my social security number, are they crazy!!!! There is no way in 'Gods Green Earth' I am going to give anyone outside the United States my Social Security Number. I contacted my attorney and she said we have a great case. Maybe someone should put their money where their mouths are and prove to others that they honor what they say on their Web site. Do I have any takers. If you are interested in going with me in a class action law suit, please contact me through this web site and I will find a way that we can all communicate to get one started. Loan fixed for 3 years, adj. 1st statement from new mortgage holder has changed interest rate to 10% instead of 8. Perhaps simple mistake. No I was about to partake in the darkest Dance Macabre that would render the twilight zone infantile. Having 1st to get the correct rate 8% back and forth w/ incorrect pay off. Amazingly I received over 15 diminutive assurances from at least 3 supervisors that they were well within their rights to cram a cactus up my bum without the benefit and forethought of lubrication. My take on this is well prior to exploring Newton and the law of physics. We need to commence with baby steps and first examine benefit and forethought. Let’s all cheer for what attracted us here in the first place Owcen’s customer pledge and mission reassurance. In other words, which cacti would you prefer, prickly hard straight thorns, or the extremely popular charmin soft feel razor wire. Ocwen Loan Servicing, The Contingent Modification Agreement -- from Hell! Orlando Florida

I entered into a forebearance agreement with Ocwen last year when I took a $1000 decrease in my monthly income. I paid Ocwen faithfully at the same time under this plan. They cashed my checks on the 3rd or 4th of each month. I discovered, however, that they had reported me to the credit bureau as late -- EVERY OTHER MONTH. They explained that this was due to their 'internal' accounting process that held a payment in suspense one month, then released it the next. I gave up trying to figure out how Ocwen could cash a check on the 3rd or 4th of EVERY month, but decide to report it as late 5 out of 10 times. I contacted the Consumer Ombudsman's office for assistance. After their review, they determined that the payments should have been reported late every month!! They changed the info in the credit bureau to reflect that ALL of the payments were late, and then tacked on an additional $800 of late fees! Okay, I understand that contractually, I am late; under the forebearance plan, I am not. Can't fight that logic.Since those 5 late payments prevented me from refinancing my adjustable rate mortgage, I decided I would go through Ocwen's loan resolution folks to see if they would modify the loan to a fixed rate. They agreed, but here are the hoops that they want us to jump through: 1. Give up any right to litigate regarding their handling of the loan;2. The amount they are asking for today can change at any time -- if it changes, it can be tacked onto the amount that I'm behind and I will HAVE to satisfy this undisclosed amount before April, 2008. In their world, if they decide to add thousands of dollars in fees and costs by April, I will automatically default on the agreement if I don't pay these hidden costs;3. All payments must be wire transferred or overnighted to them to be received by the 1st of the month. If they claim they didn't get the payment (which they have done in the past), all bets are off -- they will begin foreclosure proceedings with no further notice!4. If I am able to satisfy all of their requirements by April, they will 'use our best efforts' to notify their counsel that we have reached an agreement. If they fail to do so, it is up to me to notify the counsel, and if I fail, they will begin foreclosure proceedings;5. Remit to them any escrow balances in full; In other words, pay them by April , 2008, all of the taxes due for the entire year of 2008, even though they are not due until December. Also, pay the homeowners insurance for all of 2008. None of these expenses had been escrowed before, and they are currently auto-deducted from my checking account.Now, if I manage to luck up and Ocwen does not tack on a bunch of fees and costs, I'll have a new mortgage agreement with a better interest rate in April 2008. Until my credit score improves, I can't do any better.With Ocwen's track record of class action lawsuits and reputation of swindling customers, etc., it scares me to death. It's like making a deal with the devil. Ocwen ON HOLD AND TRANSFERRED FOR HOURS ORLANDO Florida

in these trying times with mortgages all you hear is contact your lender just dont ignore their phone calls. well i have tried to deal with ocwen since october 2007 to try and lower my interest rate back down to where it originally was. in oct i requested loan mitagation papers from ocwen and now here it is dec 11, 2007 and i still dont have those papers. i also requested them again in nov and still dont have them. my mortgage went up 900.00 and is really causing me pain. after sitting on the phone for over an hour waiting for someone to help i got transferred several times and on hold again for over 45 minutes to then be transferred to an extention that said something to the effect that it was no longer in business. finally after pushing numbers on my phone seemingly like forever, getting disconnected, and putting in my account number more than enough times and going on the internet to their supposedly active prevent foreclosure department and trying to fill out my situation where the screen says you can and by the way you cant.i reached someone who said they could fax me the docks tomorrow. we will see. now that i have been paying the extra 900.00 for the third month in a row. then of course it will take them 90 days to process them and by then i will probably just call them up and tell them they can have my home and go rent an apartment and i will then be a much happier person when my whole paycheck isnt going towards this home in california that i work so hard to keep. i contacted my second mortgage with litton loan and within in 45 days they lowered my rate from 10.00% to 8.00% WITH NO PROBLEM OR DRAMANoneNONE, CaliforniaU.S.A.

I am also in a bind with this company, due to my mother's situation which disallows her to work medically, our income had shorten. I called Ocwen bank prior to hardship and I ask them that there is a finacial difficulty at this time and it would be temporary and if there is a temporary forberance for a short period of time reduce the monthly payment for at least 6-12 months until I can gain better control or the mortgage payment before it came to that point which is now. I was told that the only program they have is for me to purposely miss one month payment and then I will recieve a forberance form from them, fill it out and they will set up a payment plan which would be higher than what I was paying. I told them I dont want to miss a payment and get reported to the credit beauru but it was my only option. I want to get out of this situation. My mother told me she had to deal with them many years ago when another bank sold over to Ocwen and they double her payment and if she missed one, she would automatically lose the house. It seemed like a good idea at the time I gave her first month and sercurity and moved in.All was fine until a few months later when my mother informed me that the interst rates and monthly payments would be increasing I thought nothing of it and made those payments. 3 months later my fiance was diagnosed with colon cancer and his income stopped and since I was already on disability money got tight I decided to contact Ocwen to inform them. ( my mother had givin them permisson to talk to me) I was told that my mother was 1 year behind and that they could not make any more arrangments with me. I started to make partcial payments missed some months and until of course foreclosure. I was told that I did not have the funds to make any more arrangments with them so I went out against my doctors orders and found a part time job then I called a Credit Counseling agency that tried to help me and emailed Ocwen and told them that I had the income to reinstated the loan and to put the 13,000 in behind payments to the end of the loan and start fresh. Ocwen said to give them 72 hours to make a desion I called them back when I did not get a response and was told that they sold the house Oct 24 2007 for 81,000 (which no one purchased) and that they never got a email from a conseling agency or got it too late and that in order to reinstate the mortgage I needed to come up with 25,000.I dont have that kind of money and I am the only income that my family has. Then to add insult to injury Ocwen emails me on the 27th of Nov telling me that they have a reinstatment quotei ( which gave me this web site) but when I call to talk to them about it they gave me a number that was a fax machine and no other information. I have the income to pay the mortgage now but they refuse to give me a chance I know they just want this house but due to all of the repairs it needs they could not sell it at the sheirff sale for 81,000 so they sent it to a realator which is in for a surprise when he sees whats in store for him when he tries to find a buyer other than me that is willing to take the house as is.TammiGrand Rapids, MichiganU.S.A
