I am having the same problems with Ocwen all the fees and hours on the phone on hold! I admit I was behind on payments but I made ever effort to fix it I did everything they told me too and am still behind by there calculations! I am considering hiring a lawyer! Dose anyone know any less costly way I can report them and get some legal advice on how to fight them! I had a forbearance plan in place paid it and there was a modification after that they lost my paper work when I sent it in I was smart though and sent it certified! I had to fax them copies of everything! I now find out they have been miss applying my payments to the old forbearance plan not my modification!

Ocwen Mortgage Company This is a Long Hard Journey, But We All Need to Have the Courage to Continue No Matter How Hard the Going Gets
I would like to know what is the latest report on the complains against Ocwen Mortgage Copmpany. I read so many complains posted here on Ripoff, but have not read any results from the complaints.
I'm also a victim of Ocwen Mortgage Company...and I truly regret that I refinanced from my previous Mortgage to Aegis Lending. Aegis Lending went bankrupt last year and Ocwen took over.
Well, when Ocwen took over, I was told that I was behind my mortgage payment although, it was not my fault that it took Ocwen 3 months to update records from the previous lender (Aegis) yet they count that as being the fault of the borrower. Yes, they have threatened to foreclose my home, but I will not let that happened.
I have asked for options and Ocwen put our mortgage loan under a forbearance plan, meaning that payments has increased. In the interim my payments will have covered the previous late payments within a given date.
I have hired a company called 'American Forclosure Service' to work with Ocwen in working out a 'Modification Plan' which means to lowering the interest rate of the loan...I've worked with AFS since May 2008 and neither I nor the AFS has received any agreement or approval from Ocwen.
I feel that I've exhausted and tried ways to work things out with Ocwen, and my next step is to write to Congress and copy of this letter to my lawyer. Yes, I have records of my monthly payments and other important documents for proof.
I feel that as long as I'm under the forbearance plan and paying my mortgage monthly, I have good grounds and evidence.
It is going to be a long process...together with lots of prayers and having faith in Our Almighty God...something good will come out of this. Yes, I have setbacks and disappointments with Ocwen, but I feel that I can succeed in spite of this misfortune. The key is having the courage to keep fighting no matter how hard the going gets. He, who falls nine times, but gets up tem times is a success. Success is a journey, not a destination.

OCWEN / OCWEN LOAN SERVICING DECEPTIVE PRACTICE, BOGUS FEES, UNAUTHORIZED LOAN MODIFICATIONS, RIP OFF SENIOR CITIZENS ORLANDO AND WEST PALM BEACH
This company contacted me about 'lowering the interest rate on my elderly mother's loan'. When I received the paperwork it was for a 'loan modification that put the loan in a forebearance status'. My attorney advised against that and I responded in writing that we did not agree with or accept the 'modification documents'. I have made 17 phone calls and spoke with people who give false names in every department. They have charged fees and still show that the loan is in a forebearance modification when it IS NOT and the payments have all been up to date.
In addition, I get phone calls on my cell phone still asking for me to return paperwork from January for a modification that the 'modification department' says is not approved because the lender WILL NOT ALLOW a modification. Go figure. I have all these phone calls documented with dates and names. I have spoke with the Florida Department of Consumer Affairs and was told that they have numerous complaints against Ocwen.
The only way to keep the loan out of their default status is to pay the fees they attach. They will not give me the contact name of the bank that underwrites the loan, I get transfered, put on hold, transfered, put on hold, only to speak with more people who I can't understand. The only success I had was to get one lat fee adjusted after threatening to contact the media.
This loan was originally with Country Wide and was sold to Ocwen, and then sold again. My father passed away last year and I am trying to help my 85 year old mother NOT LOOSE her home.

Ocwen Federal Bank Ocwen stoled my home of 10 years to make $20,000.00, they cost me my job. West Palm Beach Florida
03/94 I entered into a forbearance agreement with HUD. I was convinced by HUD and Lincoln Service Corp. that this was necessary. I was very confused why this was needed. The forbearance agreement would save me $18.35 per month and increase my purchase price from $42,900.00 to $43,000.00.

04/98 Began receiving letters from Ocwen stating my loan was in default and they would attempt to collect the entire amount of the loan. I was not behind on any payments when the collections letters began. At this time, I began sending all payments through Western Union-Quick Collect so I would have documentation of payments made and received.
02/03/99Received Notice of Acceleration from Ocwen, demanding entire amount of $56,927.58 in full. Called the 1-800# provided in the letters, customer service, all they would tell me is the entire amount would need paid or they would foreclose. It took several phone calls to many numbers before someone agreed that only my regular payment was due, not the entire amount. Was informed the demand for payment in full was a computer generated letter sent to all customers. I consulted attorneys to assist in the threats they were making to take my home. The attorneys all wanted $1000.00 - $2000.00 up front with no guarantee. I did not have that kind of money and was afraid Ocwen would take my home.
05/04/99 Received another Notice of Acceleration from Ocwen, now demanding $57,040.08 in full. Again, I called many times before I could speak to someone who explained that only my monthly payments were required. I was not behind in payments when I received this notice.
06/11/99 Received a notice that July 1999 payment amount would be $15,670.19.Called, again I was told that this was a routine mailing, nothing to worry about, just continue making my regular monthly payment.
06/25/99 Ocwen's attorneys filed a suit against me; summons delivered in person on July 1st, demanding payment in full, $41,741.66 on principle and stating foreclosure of property.
07/01/99 Ocwen returned my June and July payments - $772.00.
07/99 Received letters from Ocwen demanding different amounts be paid or they would foreclose, one amount - $16,303.08. Several letters on their letterhead were not signed.
08/02/99 Ocwen returned my August payment - $572.00.
08/04/99 Tried again to find an attorney, with my limited resources. I could not find an attorney that understood the situation or was comfortable suing a bank. I sent a letter to Ocwen stating I was countersuing, claiming wrongful foreclosure, stating they had returned 3 payments in a row to purposely file foreclosure.
08/11/99 I sent a letter to Ocwen requesting information;When did my loan change from 9% to 10%, why and why wasn't I notified? Requested amortization statement, had never received one from Ocwen.. I wanted to know the exact application of my monthly payments.Information returned; 08/01/97 04/22/99 only $462.00 went to principle.
08/99 New forbearance agreement entered with Ocwen. They agreed to put back interest that accumulated, while HUD had my mortgage, to the rear of the loan, which made me current. They will accept my monthly payment and suits against each other would be canceled. I did not know until this time that the forbearance agreement with HUD was so damaging, that none of the money I paid HUD, $15,525.00, went toward my mortgage.
09/99 Ocwen again sent back my monthly payment, $400.00.
11/99 Ocwen sent me another letter of acceleration demanding; $19,650.00. After the above arrangements were made and they convinced me everything would be fine, I would not lose my home, they again began sending letters demanding huge amounts or I would lose my home.
12/01/99 Filed Chapter 13 to save my home. Payments of $250.00 made to; Terry Smith, Clerk of Court, Tampa, FL.
07/31/00 Chapter 13 hearing, resume payments to Ocwen, per court order.
09/12/00 Ocwen sent an acceleration notice, full amount due - $67,286.65.
10/04/00 Ocwen filed for mediation to resolve differences. I appeared as directed, no representative of Ocwen present. The hearing officer reschedule, again I attended but no one from Ocwen attended. The hearing officer dismissed the mediation, failure to attend by filing party, Ocwen.
10/13/00 Received new forbearance agreement from Ocwen stating $1000.00 down and monthly payments of $517.00 per month.
03/22/01 Court dismissed Chapter 13.
06/30/01 Met with manager of Bank of America to refinance my home and get away from Ocwen.Ocwen refused to cooperate and would not sell my mortgage to my bank.
09/21/01 Notice of intent to terminate forbearance agreement received from Ocwen, amount due,$6239.53.
11/09/01 Ocwen again filed foreclosure on my home demanding; $65,901.38.
12/06/01 Received another letter from Ocwen now demanding; $6952.68.
12/07/01 Filed another Chapter 13 to save my home. Again I could not afford an attorney to assist me with problems by this mortgage company. The attorneys I spoke to did not understand HUD purchased houses or what Ocwen was wrongfully doing.
07/09/02 Ocwen attempted to convince me to cancel the Chapter 13 and reinstate a forbearance agreement again. I refused because they had lied so many times and I did not trust them. Somehow, they convinced the court that they had the right to foreclose and the foreclosure sale of my home was scheduled.
08/02 I contacted an attorney to handle a Chapter 7, my 13 was converted to a Chapter 7.
They would not assist me with anything prior to the Chapter 7 because they would be entering after the fact and for liability reasons could not be involved with the circumstances of the past two years. In Florida you can keep your home when filing a Chapter 7, but since Ocwen prevented me from making payments, I was behind and did not qualify, and would lose my home.
05/03 Phone hearing to resolve Chapter 7 took place. Chapter 7 discharge set for June 2003.
09/03 Contacted the courts for copies of my discharge documents. It was not filed in June as scheduled, but they would file it now.
03/04 Received notification from Ocwen, stating the outstanding balance on my home of $41,268.77 is resolved with the Chapter 7 and fair market vale is $60,000.00. I was not provided a penny of equity even though I made 10 years of payments on my home.
All the stress and worry during the time Ocwen took over my mortgage caused problems in other areas of my life. I lost a lot of time from work for court appearances, etc. I worked for the State of Florida. I was terminated from my 15 year career job.
Ocwen stole my house from me after 10 years in my home. They caused me to lose my career job of 15 years, they ruined my credit and left me with nothing.
I am very interested in suing Ocwen for the damages they have caused me, loss of my home, my career & benefits lost. Ocwen should be held accountable for the damages they have caused us home owners. Several home owners only had a one time shot at home ownership and Ocwen ruined them for life. Thank you for listening.

I entered into my second month of delinquency I was able to get a money order in the mail to Ocwen and it was sent back to me stapled to a financial report demanding that I complete this form so I did and at the same time I was called and asked a million questions over the telephone and was told oh you can afford a much higher mortgage payment I can complete a foreberance for you with an escrow and at the end of the 12 month foreberance you mortgage payment will reduce back to the original amount and you will have cash in you escrow. So I went for it and noticed after I paid 2500.00 down on this foreberance I still continued to get statements with late fees, attorney's fees, search title fees and the list goes on and I checked the bureau and my payment history was a mess I was reported over 30. 60. and 90 days late on my moetgage history so I called Ocwen only to get someone I could not understand there was a language barrier and he would not put anyone else on the telephone. I CALLED BACK AND GOT SOMEONE TO TELL me a mass of lies. after the 12 month foreberance period I was sent another financial form to be completed and 2 options, a repayment plan or listing my property for sale consequences loss of prperty, Damaged credit rating, deficiency liability, and tax ramifications. I was never given an answer as to where all my extra money went Ocwen could not produce a itimized bill and to this date Ocwen is trying to raise my mortgage payment again and force me to complete another financial report what can I do they has scared my credit and lowered my scores to the point were I cannot get a refi nor a new mortgage therefore i'm stuck with no way out what can a man do when he is striped of all his rights and dignity.

I was never given an answer as to where all my extra money went Ocwen could not produce a itimized bill and to this date Ocwen is trying to raise my mortgage payment again and force me to complete another financial report what can I do they has scared my credit and lowered my scores to the point were I cannot get a refi nor a new mortgage therefore i'm stuck with no way out what can a man do when he is striped of all his rights and dignity.

I am writing this response like others to the experience they have had with Ocwen. It started when I could not refinance, and could not make the payments after my 2 year interest only mortage. I spent countless hours on the phone with these people getting the run around, one time spending 3 hours of I have to transfer you to, holding, to I cannot help you with this, I will have to transfer you again.First off you cannot understand them as they are based in india, and when i had repeatedly asked for someone in the states they said there was no one!My forbarance agreement was so open-ended; 1:they wanted 3 months down payment2:impound my taxes after i had already paid them3:pay insurance when i already pay it.4:and if u agree to these terms and we found out u make more we are going to take more. Who in there right mind would subject themselves to that.Also after all that i said i wanted to do a short sale they sent me the paper work and said they would contact me in 3-5 days they never did and my realtor did 2 1/2 weeks later and they are now not taking any short sales. they never call u when they say they will or send u the paper work they say they will unless it is about getting their money!!!!!

I read through the agreement, signed it on January 23, 2008 and faxed it to Ocwen on January 24, 2008. To date I have not received any notification or billing stating that this agreement was received.On March 7, 2008, I called the Customer Support Hotline to inquire about my account. At 12:36 pm I spoke with Kash who told me that she had no record of this agreement having been received by Ocwen. Kash put me on hold from 12:49 pm until 1:04 pm and then I spoke with Curtis. He told me that I had to speak to someone in the LRC Department. Curtis transferred me to the LRC and the phone rang once and then I was disconnected. I called back at 1:10 pm and spoke with Shavonne. She also said I needed to speak with someone in the LRC Department and she transferred me to that department. I was on hold from 1:16 pm until 1:30 pm until a Mr. Holland picked up the phone. He took my loan information and then put me on hold. Within one minute, Prasanna then picked up the phone. He stated to me that there was no record of the agreement and that I was to have faxed it in within the 10 days required. I explained to him that is what I did and that I had a fax confirmation to support that. He stated that this did not matter and he would be sending out a new loan modification packet for me to fill out again. I explained to him that at the time of the signing of the loan modification agreement, I was told that I had to pay Februarys payment of $1210 plus $161 in fees. Then starting in March, I would receive a new bill with the correct payment amount along with escrow amount that was needed. I did not receive that information, so I sent my regular forbearance amount of $1210. Prasanna now tells me that since I did not send in the $1371, my $1210 was being held in suspense until I made up the difference. So, my question is this: What is my monthly payment amount? What is my escrow amount? Where is the loan modification agreement that I faxed to you? I know that my foreclosure has been cancelled with the court as I have a court document stating that. I am tired of the run around that I have been getting from Ocwen for the last year. I have abided by the agreed upon forbearance amount, I signed and faxed the loan modification agreement, I call and try to straighten things out and then I have to write to the Ombudsman to get a clear picture of what the problem is and how will it be resolved. Attached to this fax, you will find a copy of the letters that I have received the loan modification that I signed, a copy of the fax cover sheet as well as all my handwritten notes. This company needs to be investigated and shut down! I have made every payment for 2 years and they say i am behind, they have missing payments, shortage of payments and i have proof all has been paid. I can not refinance because they reported on my credit as being $2000. behind in Dec 2007. There so called forbearance and loan modifications are a scam. I owe more on my loan after 5 years than what it originated for!! I have turned them into the Banking and Financing Commision and to the Credit Consumer if i get no responds from any of these people I am going to my attorney!!

we was having finanical hardship when we was solicited on the phone by a man working for a company called Regis Lending Corp. he stated that we can get some money to help us out at that time because we have equity in our home and we will keep a fixed rate at 9% and also we can skip a month of payment. that sound good. so a lawyer by the name of Paul C. Williams came to my house with the paper work for my husband and i to sign,AUG. 19th 2005 but guess what ? we never got a statement from Regis to make a payment and they sold my mortgage to ocwen with a forbearance attacted to it.as you know the intrest went up to 13% now and the late fee is over $25,000.00.my home is in forclosure.something need to be done about this its not right for hard working people to have there home taken overnight by mortgage scam.

My daughters mortgage was bought out by Ocwen back at the first of the year. My daughter works for the Federal government. She had a excellent credit rating until Ocwen came into the picture. One month after they bought her loan. She recieved a notice saying she owed ( $6000.00). Needless to say she was shocked. The first thing she said was "I have all my cancled checks for the payments." Are you ready for this, They said. "Thats not what are computer says" She is in litigation about this. They wanted her to sign a forebearance agreement. When she ask them where her money was, they told her the could not discuss it with her until she sign the forebearance agreement. If she signed it that means she is admitting she is in default of the loan.She has two loans but they only want to try and claim default only on one. (Naturally it is the larger of the two). In the process of trying to straignten out this mess she always seem to wind up talking to a "Outsourced Hindu with a heavy India accent. Needless to say this is futile. I have written to my Senator ( Blanche Lincoln) to investigate (Ocwen). Something must be done before no one has a home left to live in under this companies tyranny.If we all band together we can bring these bastards to justice. Otherwise it will be ( Just-us) who suffer.Thank you for your time

Ocwen Financial, Yet Another Case Of A Total Scam. Ocwen Scam housing West Palm Beach Florida

Just like many of the reports here I have been totally scammed by Ocwen. I signed a mortgage for my new home and before the second payment I received a letter from Ocwen stating that they where now servicing it. I didn't know anything about them at the time but found out a LOT about them as the months went on.I got behind on 1 payment due to my automatic banking. My weekly wire transfer into my banking account was late and missed the day they tried to do the withdraw for my mortgage. What was bad on my part is I had become so use to everything being automatic that I didn't pay attention to the account. I started to receive letters from Ocwen stating I was late Plus increased payment amounts. Not just late fees but other charges. I covered the payment over the phone with one of the reps. and Thought nothing of it.About 4 months later I started to receive calls from them.. 5 to 6 times a day. Telling me that I was late on my mortgage and that I was going to lose my home etc. The first couple times I tried to explain to them that I was caught up, that I had made the payments with one of the reps, turns out that they had put me into some sort of 'forbearance' program. I told them that the rep had mentions something about that but I never agreed to that. After fighting with them for over a month about it, while they where claiming that I suddenly owed over 4 thousand to get caught up, due to the forbearance program I ask them to send my ANYTHING they had in writing with me agreeing to that.Meanwhile, I started to shop around for a new loan. Thats when I found out that Ocwen had been reporting my late on my credit for (at that time) over 6 months. Due to this so called forbearance program. They dropped my credit score over 300 points and now I can't refinance. On top of all this they have raise my interest from my starting 7% to over 12%! I'm not paying it. In looking at the records they have only put 125 dollars toward the equity in my home in the over 2 years of payments I made. So as it stands now, I actually owe them more than the original loan after making 2 years of payments.I'm done. I quit making any payments at this point and they can have the house. but they are going to have to fight in court for the entire time it takes to legally get me out. In Kentucky that will take them about 2 years. In the mean time I'm banking what would have been my mortgage payment so that when the day does come I have money to get something else. On a side note, even after the 2 years it takes to foreclose on a home in Kentucky, they STILL can not sell the house for another year after getting it, because I have the legal right to buy back the house for the foreclosure rate. OCWEN EVERYBODIES STORY IS ALMOST THE SAME!!! THEY NEED TO BE STOPPED.... AND SOON!!! Orlando Florida

I have spent so much time in the last two days reading reports about Ocwen on different sights that it is becoming mind numbing. Part of me is feels better in that I am not alone however a bigger part of me....the part that is sick to my stomache and can't eat or sleep is wondering what to do next. It is starting to look like the only way out is not going to be good. I live in the home I grow up in, the one I was brought home from the hospital to, it was my grandparents home. After years away I moved back into this house when my grandparents passed away. It is not anything fancy but it is home. In fall of 2001 I took out a loan with a different finace company to make some home improvments and within months Ocwen had my loan. It was a rough start beacuse I was never notified of the take over. But I was lucky in that it didn't take much to get it taken care of. Then this past fall my husband and I were the victims of an Identy Thief and it wrecked not only our bank account but our lives. I called Ocwen to have them start pulling our payments from our new bank account...well.....guess what?! They never did. I called them then and told them that I wanted pay the 2 back payments and I would send it out or they could pull it right away. Well what was to be 610.00 had now turned into over $1,800 and I was told that the only way to correct it was to go into a forebearance plan. This plan was going to be set up for over a year and I would be shown late for that year,PLUS I would still owe fees at the end.IT WAS $ 600.00 PEOPLE!!!! On top of all of this I had recieved an ACT 91 notice. I had Two chioces go with the plan or file the ACT 91.After talking to the Pennsylvania dept of Banking and Pennyslvania Housing I took their advice and filed the Act 91. This way I could pay my back payments even if I wasn't approved for the ACT 91 and it would buy me time to fight OCWEN.In addition OCWEN could not proceed with anything. On January 28,2008 I called and found out I did not recieve the Act 91 loan.....so I called Ocwen right away to set up sending the payments. The only way they would take the payments was to set up a modified loan agreement. Did I mention that I couldn't refinance with anybody else because my credit score has went from 700 to 430 in 4 months thanks to them. The place where I where have my car payment and the a couple other lending places have told me they SHUDDER when they see someone has loan with Ocwen. So still working through Pennsylvania Housing I decide to do the modified loan and then in 6 months of good payments they ( Pa.Housing) could set me up with something. The first agrement made on Jan.28,2008 was to be e-mailed to me in a few days. When I didn't have it in a week I called back...this time talked to an American....very nice guy and he told me he believed I had set up this loan because I had the exact imformation...BUT....there was no record of my call the week before. So we set everything up again. While waiting this past week for the paper work to be e-mailed to me GUESS WHAT ???!!!! I was served with papers saying I had been sued for foreclosure. The papers were filed on 1/8/08 while I was still under protection of the ACT 91. I recieved the loan mod. papers on Friday to find out they were forebearance papers and there were all kinds of fees tacked on. Pa. Housing is trying to help me fight the fees and has told them they were not allowed to do this. I even have e-mails between Ocwens' Attorney and Ocwen that were CC: to Pa. Housing telling Ocwen they could not do that.I don't know where things will go from here but I do know somwthing has to be done and done soon!!!!! I do not want to lose my home or for that matter and really most importantly to me my pets which are my world....who rents to people with BIG DOGS,cats and yes even a lizard??? But even more so... with the state the country is in now Ocwen is not helping it. I am more than willing to speak to anyone and do anything that needs to be done. The place where I where have my car payment and the a couple other lending places have told me they SHUDDER when they see someone has loan with Ocwen. So still working through Pennsylvania Housing I decide to do the modified loan and then in 6 months of good payments they ( Pa.Housing) could set me up with something. The first agrement made on Jan.28,2008 was to be e-mailed to me in a few days. When I didn't have it in a week I called back...this time talked to an American....very nice guy and he told me he believed I had set up this loan because I had the exact imformation...BUT....there was no record of my call the week before. So we set everything up again. While waiting this past week for the paper work to be e-mailed to me GUESS WHAT ???!!!! I was served with papers saying I had been sued for foreclosure. The papers were filed on 1/8/08 while I was still under protection of the ACT 91. I recieved the loan mod. papers on Friday to find out they were forebearance papers and there were all kinds of fees tacked on. Pa. Housing is trying to help me fight the fees and has told them they were not allowed to do this. I even have e-mails between Ocwens' Attorney and Ocwen that were CC: to Pa. Housing telling Ocwen they could not do that.I don't know where things will go from here but I do know somwthing has to be done and done soon!!!!! I do not want to lose my home or for that matter and really most importantly to me my pets which are my world....who rents to people with BIG DOGS,cats and yes even a lizard??? But even more so... with the state the country is in now Ocwen is not helping it. I am more than willing to speak to anyone and do anything that needs to be done. Ocwen Foreclosure, unfair fees,unfair forbearance agreements Orlando Florida

I have read all the files about Ocwen and they all sound all too familiar to me. I am being threatened with foreclosure now so i also have a forbearance agreement which is putting me further and further away from helping save my home!! 2 yrs. ago my mortgage payment was $991 and is now $1450!! I had flooding at mu house and had a lot of damage which resulted in a lot of out of pocket expenses that our ins. wouldn't pay. Which was what put us behind . Also we paid up back taxes that we didn't know we could escrow which was a lot of out of pocket. We have had 2 plans already due to these extenuating circumstances and they are more than willing to help with huge down down payments and raising the payment. How does this help. In Oct. i paid $2489 down and $3000 in Jan. and they are still threatening me!! That's not counting the amt. i put down last year.This is ruining my credit!! They also say i owe 13,000 in arrearages !! How can this be???? I always pay my house payment each month!!I am going to investigate my payment history with them but that is gonna take awhile. I need some help now!!! Each month the continually add high late fees,and a $10 property ins. monthly!!I have never seen such a horrible company to deal with. They do not respond to my emails and there is at least a 30 -40 min. wait to talk to a representative. Then they are more than happy to help by another downpayment and forbearance agreement.This is a vicious circle with no end and i am in fear of losing my house!!!

My Husband and I also have lost our home to Ocwen. Our mortage was sold to them in Nov. 2005 and in Feb. 2006.They said we were behind and they were going to foreclose on us in May of 2006 so we filed Chapter 13 to keep our house and had the payments sent directly to them directly through the court so they couldn't lie about the payments. they increased our mortage 2 times with out notifing us and therefore show us behind even in chapter 13then in august 2007 my husband had a stroke and I could no longer make the 13 payments so we had no choice but to go chapter 7 and move. Now ocwen is still sending us statements saying we owe $7,000 dollars to them in legal fees and won't do anything with the property. I had a buyer for the property even after we lost it and they won't sell. I don't know if we even could do a class action suit now but I do know you all should persue it because they will rip you off and you will end up like us filing bankrupcky just to keep a home that in the end you will owe more for and will never pay off.

I have a loan with Ocwen and yes it's WHEN you can get throught to them after waiting on hold for 30 minutes then being disconnected... then calling back and being told different things, I had 2 failed Forbearance plans and after being told that they would not do a modification after a lot of persistance I finally got one. The first modification wanted over $7,000 PLUS the first months payment of $1,780, almost $10,000.. there was no way I could do this, so I called them back and got the most polite guy who answered our questions and was willing to take half the money $3,600 modify it at a 30 year fixed at 6%, sounds great right? Right, but the problem is my home is scheduled to be auctioned off in a week, and Ocwen still hasnt gotten back to me. When I called them they said someone entered the info wrong and I should get it in a week (1/23/08 will be a week) IF they send me the paperwork and I send them the money...my first payment is scheduled March 1st. The first guy who agreed to the modification was very arrogant and stated that they would barely break even if they foreclosed, so I felt a little relieved that they dont want to foreclose. After reading all these complaints is there anyone out there who actually went past or too the actual foreclosure date?? They told me that they would 'suspend' the foreclosure (it's in writing' But I dont know if I can trust them.. Maybe I dont have a choice because of how close I am, but If I dont hear from them tomorrow, I'm going to most likely have my ORIGINAL LOAN PAPERWORK reviewed for any and all mistakes in hopes of stalling....Chapter 13?? No, because my rate is outrageous and is scheduled to increase from 9.65% to god knows what. I'm a single dad with 2 girls and boy sure could use some advice.DerrickCOVINGTON, WashingtonU.S.A.

We purchased our first home two years ago and our loan was quickly sold to Ocwen. Our original loan started at $2330/month, and two years later was increased 40%, an additional $865/month. In addition to an outrageously high, interest only payments we have encountered these practices with Ocwen:1. They misapplied one of our mortgage payments, crediting as an 'extra' payment to pay toward the principal instead of our standard mortgage payment for the month. 8 months later, out of the blue, they reversed this payment from our loan and said we were delinquent. After many, many hours and letters to the research department they finally credited the payment back, but took out a chunk of it in fees, first, so that it was no longer good as a full payment and got locked into an escrow account as a partial payment while they continued to report us late on our payment - for their accounting error. 2. We were forced into a forbearance plan while we 'sorted all this out' being told that the alternative was to go into foreclosure - for their accounting error. We agreed to the forbearance plan under the condition that it would be reversed as soon as the error was cleared up. It never was because they took so much in fees out of the 'credited back payment' that it was useless.3. Our forbearance plan expired in October of 2007 and we paid it off in full every month and on time. We were automatically signed up for another forbearance plan to pay for property taxes. We were never even notified, much less asked for the second forbearance plan. They simply did it. I had to call to find out why we were suddenly being asked to pay so much more per month.4. We have been charged thousands of dollars in absolutely junk fees. 5. Most currently and importantly - we have just been served a notice of default when we are only 30 days late. I have one letter here from Ocwen dated December 6th, 2007 which says it is a 'friendly reminder' that the current payment for December has not yet been received. I have here also the certified notice of default dated January 3rd, 2008 - less than one month later. What has happened in the meantime is that I contacted Ocwen about modifying our loan back to it's original terms because the increase of $865/month is just too much for us. They were not willing to accommodate a modification and responded to our last inquiry with the notice of default and apparent fast trak to take our home. We are quickly trying to do a short sale so we can move on and be free of this ongoing nightmare with as minimal effect to our credit as possible. These are only the highlights - misapplied funds, junk fees, forced forbearance plans, premature notice of default (we're barely 30 days late!!) and outrageous increase of mortgage. This doesn't include the 2+hours of hold time, the stonewalling, intimidation I've encountered while talking on the phone with the representatives. Every month our statement is different, different fees, different totals of what is owed. No one will explain them to me and only highlight again and again what I need to do and pay or they will foreclose.We would definitely be interested in joining any class action lawsuit. last year we signed a forebearance agreement to avoid foreclosure. our payments went up $200. we paid every single month on time, though often they didn't deposit our checks until the day after the grace period. creating a late fee. though we contacted them thier response was 'send you payment earlier.' what if we didn't have the money in the bank earlier and by some miriacle they made a swift deposit. then we pay a late fee and an overdraft fee.and you are charged an insuffecient funds fee by them. our complaint is, after a year of payments we recieved a huge tax bill with notice of intent to sell our property. ( from the state). we notified ocwen to find out what it would take to pay off the forebearance and all fees and escrow deficits. we were informed that we were 3 months behind and it would take about $14,000 to get us back on an even keel and get our payments reduced to the original payment. our monthly bill never reflected any info about this. an unhelpful sarcastic foriegner at ocwens customer service informed me we were only making forebearance payments and were still behind. asking what months we were behind she said, oct., nov., and dec., 2007... what? the past 3 mos. which we paid and she agreed we paid, but claims we only paid the forebearance.. the same amt. we'd paid every mo. for a year but for some reason the rules changed in oct. the amt. of the original forebearance was $8000. after 1 year we owe $14,000. the more we pay, the more we owe. we only owe 13 years on the house, but it isn't worth trying to save at this point. we didn't choose ocwen, our loan was sold to them when our original company filed bankruptcy. they inherited our insurance dept. and a $12,000 insurance settlement due us after hurricane francis was lost in the shuffle. we still had to pay the premiums to ocwen. no one knows where the insurance money went. why can't our gov. regulate these thieves and protect us. if ocwen offers you a forebearance agreement to save your home, get a lawyer first. it hasn't helped us.we struggled for a year when thier intention was always to get more money and the house in the end. well, the jokes on them.. remember that hurricane?Edwardlakeland, FloridaU.S.A.

( from the state). we notified ocwen to find out what it would take to pay off the forebearance and all fees and escrow deficits. we were informed that we were 3 months behind and it would take about $14,000 to get us back on an even keel and get our payments reduced to the original payment. our monthly bill never reflected any info about this. an unhelpful sarcastic foriegner at ocwens customer service informed me we were only making forebearance payments and were still behind. asking what months we were behind she said, oct., nov., and dec., 2007... what? the past 3 mos. which we paid and she agreed we paid, but claims we only paid the forebearance.. the same amt. we'd paid every mo. for a year but for some reason the rules changed in oct. the amt. of the original forebearance was $8000. after 1 year we owe $14,000. the more we pay, the more we owe. we only owe 13 years on the house, but it isn't worth trying to save at this point. we didn't choose ocwen, our loan was sold to them when our original company filed bankruptcy. they inherited our insurance dept. and a $12,000 insurance settlement due us after hurricane francis was lost in the shuffle. we still had to pay the premiums to ocwen. no one knows where the insurance money went. why can't our gov. regulate these thieves and protect us. if ocwen offers you a forebearance agreement to save your home, get a lawyer first. it hasn't helped us.we struggled for a year when thier intention was always to get more money and the house in the end. well, the jokes on them.. remember that hurricane?Edwardlakeland, FloridaU.S.A.

I was amazed when I googled Ocwen and found this site that I am not the only one being taken by them. They are charging me all these crazy fees I dont even no what for and I cant understand them (INDIA) I am in the forbarence with them HELLO I could'nt do 1400.00 but Forbarence me with a 1919.19 payment they are trying to say I have 7 missed payments..No I dont!! I dont want to loose my house and ruin my or what is left of my credit..what can we all do about this?? does a laywer help?? they are saying 14,000.00 will get me out of forbarence..where did they come up with this.. I get so frustrated...for I week I tried to call and the where having tech difficulties...I was on the verge of having a stroke!!!!WbabcockWolverine, MichiganU.S.A.
