My mother had been ill with cancer for over a year and I had quit work to care for her. I did one loan modification with Ocwen and was so distraught that I did not realize that even tho they gave me a lower interest rate my payments were higher? How could this be? I kept my mortgage straight till my mom had a relapsed and I got behind again. We were use to two incomes and now down to one. I tried to work with them again and they sent me all the paper work but when I told them I faxed it they claimed they did not receive it. I ended up faxing it three times to have them say they didn't receive it. In the mean time my mother was home with Hospice and she passed. I had explained to them what was going on and had trouble with finances due to my not working. They had no concern. The paper work they sent me was on the day my Mom passed,which in no way was going to get back to them in the time length they gave me because of my grief. Then they claimed they sent me a modification that I did not get. I tried again to talk with them about the loan even up to two days before the sale trying to figure something out and was told that they couldn't see how I could call them and that I needed to just come up with the $4800 to save my home. They put it on the aution block but it didn't sale, so now I don't know what they will do. They seem to only work with me when they thought I was going to get money from my Mom's passing but everything went to my Dad which is how it supose to be. I have lost my home without even a chance to keep it and it wasn't entirely my fault. I do take some of the blame for not keeping in touch with them more often (I guess) but they just was rude and now I don't have my home.

Ocwen Loan Servicing Sold house even after modification was approved
In October we worked with a 3rd party to help modify our loan. After hours of deliberation, Ocwens Mr. Marshall and us finally came up with an agreement. We were to pay our loan amount of $5387.00 in November (we did) and $4135.28 in December (we did) and then had to pay principal and interest of $3939.96 in January (we did).The modification was taking what we owed and moving it to the end of our loan $618,434.73, stuck 40Kplus to the end of our loan and lowered the interest rate. Exactly what we were requesting, payment was still a little high but managable. Make a long story short we received a letter on 2/18/09 from a paralegal stating that county records stated our house has been sold. Since it didn't have a name on it I thought it was junk mail but took the chance and called Ocwen anyways. Heard the message that 'Thank you for your payment rec'd in Jan as of May 2008 your balance is $0. Confused I pushed to talk to a representative.He stated yes our house has been sold, that the modification was approved but the forbearance wasn't so they accepted our money but never intended to keep their word.I asked to speak to someone else, he transferred me to REO left a message and of course no response as of yet. I went online to the Tax Accessor and ran our parcel number, our house was sold to HSBC for $355,000 and went 100% sole owner to HSBC, on 2/17/09.Another ironic thing is we had our house up for short sell and was given an offer of $419,000 and Ocwen declined it but yet they accepted the offer of $355,000.Then we rec'd a call 2/20/09 from a representative requesting cash for keys. Of course I said no chance, that something is wrong and they have done us wrong.She sent me to a Manager, again he was requesting the same thing keys for cash so I told him the story and said I even have all the documentation to prove it. He sounded a little shocked and said he would hand this over to someone to research it. As of right now we are in limbo, we retained a lawyer, not sure what good it will do. But we were tryig to do the right thing and it appears Ocwen had no intentions of honouring their word.Since the moment I knew we were in trouble I have been upfront with them and tried to work with them and never once did they until we paid a 3rd party to get involved. We feel we have been scammed and treated as less than. We will not let this defeat us but I guarantee you they will have a fight on their hands. I will go to the media, I intend on writing letters to congress and our legislature, not sure of what will get done, but I know someone somewhere will hear me.

OCWEN LOAN SERVICING AGREED TO LOAN MODIFICATION, NOT TELLING ME THAT MONTHLY PAYMENTS WILL INCREASE
I first contacted OCWEN about loan modification and they told me it had been granted. But after several months of waiting I never heard from them again until I got a foreclosure notice. I then contacted OCWEN again and they told me that I should have contacted them after I didn't receive any documents from them. When I told them that I did contact them I was told not to worry, We don't want your home, then came the foreclosure notice.I was then contacted by a company First Univeral about a loan modification, but was told by the case worker that OCWEN had made an offer to them, and that was the best that they could do because of the pending sale of my house.After coming to an agreement I continued to get threats fro OCWEN about foreclosure. When I got the documents to sign from first universal I learned that they worked for/with OCWEN. Now recently I have been getting correspondences from OCWEN stating that I am in foreclosure and that the monthly mpayment I agreed to have the potential to increase due to ESCROW, that wasn't part of the agreement. It was stated that I would pay a certain amount set for five years then my monthly payments would increase significantly. That's not a Loan Modification, that is a ripoff/scam.

Ocwen Loan Servicing, LLC Unable to get Modification on Mortgage and False Notices for Mortgage Foreclosure Sale
We recently hired a company to help get a forebearance and a modification on our mortgage (which was a scam), we were informed to we were not aloud neither options with our mortgage company. We informed this on 1/13/09, one day before our sale date, (we also called Ocwen on this date), which was suppose to take place on 1/14/09. We called an attorney and were told that because it was a day before the sale date there was nothing we could do. We decided that we could not afford the amount of money Ocwen wanted, which started at $5749.30, then went up to $9799.84 on 1/13/09, so we let our home sell, or that's what we thought. On 1/16/09, we recieved another notice of mortgage foreclosure sale set for 1/21/09, with the reinstatement cost at $13766.11. When we recieved this notice we call the County Sheriff and asked if there were any sale dates set for us on 1/14/09 or 1/21/09, the sheriff office informed us that there was no such date set, nor was there a sale on 1/14/09. On 1/22/09, we recieve yet another notice, which included a Notice of Mortgage Foreclosure Postponement for the sale that was suppose to take place on 1/14/09, which of course we know never was even set. So now we have another notice of mortgage foreclosure sale set for 1/28/09, (which was put on a plain white piece of paper), this date is truely scheduled for said date, confirmed by the sherriffs office. On our pink colored paper that is titled Help For Homeowners in Foreclosure the date for the sheriff's sale is typed in as 1/21/09. There no reason that people should be mislead this way, and the notices are suppose to be serious not a means of buying time to make more money for themselves, nor should they be used as a means to scare people. We are left with no time to negoticate our mortgage, and we were almost unable to file bankruptcy in time, because we were mislead. If we hadn't called the sheriff's office about the sale dates, we might have been to late, and now instead of modifing our mortgage we are stuck with our high interest rates and $320.00 more a month payment for the bankruptcy. So in all we have lost also most $7000.00 to save our home. Please let us know if this has happened to you, or is happening to you. And if anyone has any information as to who we can contact for help. We are interested in filing a lawsuit.

I almost lost my home due to loosing my job and at the same time my loan went from 8% to 11.25% in a years time. They were nice enough to offer me to enter into a forbearance agreement to reinstate my loan with agreeing I would be refinancing with them with on-time payments during my forbearance agreement which was for 6 months. The payments had gone up from $806 to $1551 a month. Right away I contacted a Realtor to put the home up for sale and she refused to touch it because the county had a red-flag marking my property up for sale. After long drawn research with the county and Ocwen turns out Ocwen had put up the property for sale/foreclosed, without even a notice to me. So now, I find out that my original loan of $108K is now a total of $121K. Time and time again requesting detailed charges from them they finally send me a spreadsheet with a tremendous amount of charges such as appraisals, certified mail, property inspection fees etc. All which they refuse to furnish me proof. They have two to four appraisals and inspection fees and over 5 certified mail fees posted to my account. This is outrageous. Seems they want me to loose the property.

Ocwen charging me late charges of $1520.25 and I have never been late and I have copies of my payments
ocwen has been sending me statements in the mail saying that i have current late charges of over a year old. i was never late and i told them this. now i receive an letter for them saying to aviod possible negative consequences of unpaid past due amounts on your mortgage loan without having to increase your payments.
they want me to sign this notice saying that they can add this amount to my mortgage or this may result in foreclosure. i will not sign this notice because i donot owe ocwen late charges.
this company should have never been in this business, they are only trying to ripoff as many people as they can, before they are closed down.
any type of suites filed against them i am with you all the way. someone has to stop them from ripping honest people off.
i am so thankful that i am one of those people that makes copies of everything.
my sugguestion to all the readers is to always check into any company you deal with(sometimes things may seem good at first but there may be a trick down the line).

Ocwen Loan Servicing, LLC Ocwen caused our property to go to Sherrif Sale, screwed up our Escrow & should be accountable.
Our problems with Ocwen began as soon as they took over our mortgage from Met West, Inc. We had no problems before then. Met West sent us a letter stating that nothing would change, just the payments would be made to Ocwen, now.Not so. We noticed that with the first payment they received, no escrow amount was taken out. When it happened again the second month, I called and was told that our loan did not have an escrow account...which I was able to disprove with our original loan documents. They ended up changing things..and implemented the escrow again..but right away we were told of the escrow shortages, and how our payments would go up to reflect those shortages. Ok...so now a piece of land that was originally $262 per month (escrow included) was now going up over $100 per month. We dealt with that. For the two years...all seemed fine. Until my husband was reading the newspaper and saw our piece of property up for Sherriff Sale for non payment of taxes. We were floored, because our school and real estate tax bills were sent directly to Ocwen for payment, our mortgage payments were paid, and paid on time...so what reason did they have for not paying? We of course paid the tax bill & further researched to find they hadn't paid the school taxes, either. So now they are supposed to reimburse us for the real estate taxes we paid out of pocket and also have to pay the two years school taxes...and after they did, my mortage went up to almost $500 per month! They said there were again, escrow shortages..and up the payments went again! We can't understand...we are paying, they are putting aside & not paying...so why do we have to again pay MORE?!! Fast forward a few years...and obviously we were having trouble paying a mortage that had doubled from the original loan (not adjustable, fixed 10%)Even when we pay a payment on time, they hold it until they can charge a late fee....We've been threatened with foreclosure when barely two months late, have been forced into a forebearance agreement that is unfair. (They give 10 days from date of letter to contact a lawer, yet you receive said letter 7 days after said date...is 3 days enough to have attorney review?!)As of now, they claim negative escrow balances at the beginning of each year, but take much more than what is needed to pay a $1200 real estate tax bill and a $155 property tax bill. They take $199.44 monthly = $2393.28.What happens to the remaining $1038.28 per year???!!!! I just demanded an escrow history...which of course will cost us more money..and we are having a financial expert look over every piece of paper I have from Met West to Ocwen. The long & short of it...Ocwen is a total Rip-Off..thanks Ripoff Report!

It's plain and simple we had to refinance to get a more reasonable payment so that we could save ourselves from foreclosure...Apparently It meant nothing to the mortgage banks and brokers above that we have children and live paycheck to paycheck.We would tell our story about how we got screwed by all of these companies to basically every company that was calling us and urging us to refinance.We believed what they were saying because we figured that they knew more than we did when it came to refinancing and getting out of foreclosure.They lied to us It was nothing but the bait and switch when it would come to the closing...we would sign all the papers as we were told to do and also told that our loan would not be sold again...We must have been with the closing mortgage company probably not even a week before they sold our loan to someone else and then the monthly payment suddenly would change as did the rate! Due to that fact once the mortgage company changed we had already sent our payment to them and because the payment did not get to the new mortgage company on time we would end up getting late fees which we did not deserve because our loan was not to have been sold in the first place!! Now we are with countrywide because we were sold to them we were told that we had a principle and interest loan payment for 30 years at a fixed rate of 7% and then we come to find out that we were lied to and we only have a 2 year fixed loan it is interest only so all the money we have paid has not done anything to bring down the loan amount from 318,000 and once it goes adjustable we will wind up having to pay 4000.00 a month as our monthly mortgage payment!!!! That is unbelieveable to think that these companies would do these things to people who trust them to do the right thing...we were lucky to get out of foreclosure because our mom and aunt gave us 5,757.93 which they did not have....and now the new bill for april is here and we owe once again 2,900.00 which is completely unaffordable to us!Countrywide is where we are now and they themselves refuse to help us lower our payments telling us that we dont even qualify for an fha loan that you have to make at least 60,000 a year and because of our late payments it puts us in a bad light....of course our credit was ruined by these shyster companies every time they would check our credit score they would pull it more times than necessary and that would make our credit score go down...This is just completely unfair I think that these companies should have to pay for what they have done to us as well as others who trusted them i think that they should be sued and or given jail time because they stole from consumers by deceiving them...theft by deception is a crime!I am willing to go soooo public with this answer any questions anybody might have I also find it interesting that once you close you can never contact the broker you were working with before the closing ever again!!! I tried contacting someone from topdot names andrew left him a message on his cell letting him know of our difficulties and that we stand to lose our home because of his and his companies unlawful mortgage practices and he never called me back which i expected would happen they are only interested in your money not helping you at all!!!

OCWEN Loan Servicing
I just found this ripoff report site today as I was researching what ever happened to First Alliance Mortgage ( the company that Cal Vet allowed us to encumber our first mortgage with a second in place with in 1992 ) at some point in time somehow Ocwen became the company we were paying our second mortgage to ( the payment history I received from them indicates we have been paying them since 07/01/2000 ) our loan 'matured' in Sept. 2007. Not knowing exactly what that meant because ocwen also sent paperwork to send for a payoff quote I began my quest for information on what to do since the payoff quote stated that they wanted 5000 plus dollars and we were not in a position at that time to pay it off if we even owed that amount. I was told by one of those employees that takes calls from the cue 'just go ahead and keep making your payments' I did this and they recorded it as a payment on Nov. 7,2007 and now the recorded statement message says the next payment due for Dec.1,2007 is 191.66 we have not made a payment since then. The monthly statement that we have been receiving since then shows amount due 00.00 I have not been able to satisfy myself that we indeed owe any amount due to the impossibility of ever being able to reach anyone in the USA. We have now received a foreclosure notice and I am not sure what to do after reading all the ripoff reports on this site this evening. I would like to know if there is any help by reporting on this site and letting others know your personal plight.

Ocwen Loan Servicing Company offered forbearance to resolve difficult arm loan and filed foreclosure default the next day
In 2006, I purchased a home in California. Shorly afterwards, my loan was taken over by Ocwen. It was an adjustable rate loan set to increase after two years. Once the loan was about to go up, I found that refinancing was very difficult due to a drastic drop in home values in this area.I began to fall behind in my payments and Ocwen offered a loan modification and forebearance option which I agree to accept. Ocwen required a cash amount of $2400 be sent via Western Union on Oct 23rd to reset my loan back to a current status and eliminate any possibility of a pending default being filed(according to them). After wiring the 2400 dollars on October 23rd, Ocwen in fact filed the foreclosure default the very next morning October 24th. They havent returned the money and they ordered the house to be auctioned off. I am facing having to live without a home for a very long time with ruined credit and very soon a sheriff will be dispatched to my house to enforce the fraud which I believe Ocwen has committed against me. I have filed a report with the department of corporations and Ocwen responds with irrelevant information with no bearing on the problem.If anything can be done to help me, please contact me.

OCWEN LOAN SERVICING Ocwen Blatantly Lying To Decieve Customer
I inquired about a Loan Mod with Ocwen back in April 2008 and submitted my paperwork (via certified mail) on April 25th.....I was told it would take 15 days to process. After countless phone calls to their 'Customer Service Number' which is in India I finally received the Modification Agreement @ 5pm Friday, June 20th. The agreement stated I had till June 25th. to sign and send back with my down payment. I noticed right away there was some very vague language in the agreement. The first item was in the cover letter and states:NEW MONTHLY PAYMENT: $2,542.59(which may or may not include escrow)Second item was in paragraph 3 which states:'Any payments due for taxes or insurance will be your responsibility in addition to the payments of principal and interest required under the terms of this modification.'I called OCWEN to go over the agreement and asked if my taxes & insurance were included in the monthly payment. Anthony in Bombay assured me the taxes & insurance were in fact included in the payment. Great!! I told him that there was an error in the cover letter and in paragraph #3 that stated that they were not included and asked him to please correct the error. The answer I got was astounding. Anthony informed me that this was their standard agreement that had been approved by the legal department and COULD NOT BE CHANGED. I asked him why he was telling me one thing on the phone but the agreement clearly states otherwise. Anthony informed me (in a very threating manor) that if I did not sign the agreement 'as is' that OCWEN would put my home in foreclosure. Which they ended up doing 2 days later. The next item I inquired about was paragraph 9c that states:'Any expenses incurred in connection with the servicing of your loan, but not yet charged to your account as of the date of this Agreement, may be charged to your account after the date of this Agreement.'I asked Anthony what 'Any Expenses' were and he informed me that was 'legal fees and stuff'. I told him I thought that term was very vague and asked if he could be more specific. This inquiry seemed to irritate him emencely. Again I was informed that this was their standard agreement that had been approved by the legal department and COULD NOT BE CHANGED....along with the standard threat of foreclosure. I feel I'm being forced to sign a misleading agreement that does not reflect what I'm being told on the phone. Aside from hiring an attorney (which I can not afford) what can I do?? WTF?

Ocwen Federal Savings Bank Ocwen Stole my home ofter 16 years
As stated to many officials, attorneys, help agencies; Ocwen Stole my home!In March of 2003, after reinstating a new forebearence agreement and payment made, Ocwen took me to court and within 3 weeks, I was ordered to move.
I was taken by legal persons who stood before the judge with me, I never got Legal Assistance help which one of the judges referred me too. I got help, but Ocwen lied to them and wouldn't cooperate. I can't tell it all, but I have every document. I have been homeless, embarrassed, devistated, and overwelmed by representatives who offered to be the peoples support and allowed these thevies to do this. Now in 2008, homes are being loss daily. I believe that God is using me, because my home was a blessing from him. I've learned a lot, but until Ocwen answers; I'll never be complete. I feel for everyone who has endured their evil, but as God gives me strength--we'll all be blessed. If you want details, I have them.

After one year of payment on time, Ocwen started charging hidden charges such as(12.95). After only being late once they sent my money back and added on charges ranging to 2 thousand dollars.
They kept sending my credit report false info stating I was late every month some times 90 days late.I was not, I contacted them they told me it was in forclosure and I paid them over 6 thousand dollars being a stupid young lady, this stopped that proceeding then every month they would send back my check stating I was a penny or ten cents under my payment.Now they tell me it is in their forclosure system again.
I am desperate I don't want to lose my grandfathers house. I can't get out from under them because they have ruined my credit and I will lose the only thing left of my grandparents.

Ocwen Loan Servicin is slowly killing me & my family
We purchased our home in July 2006. Remember this date you will see it again!Within one year of purchasing it, our mortgage was sold to the 'troll beasts' aka Ocwen LLC. Since then, according to the rude employees at Ocwen, we have never made a payment, and now owe $15,000.00 more than the house was appraised for.When we took possession of our house, (Our first I might add), we did so in July 2006 with the first payment due in September 2006. We are trying to refinance our home to get out from under the 'troll beasts'.I returned home from work (I am a Law Enforcement Professional) my wife informed me that we are listed on our credit score as being 24 months late. Thanks a @#!% lot Ocwen. Remember the July 2006 date mentioned above? Although we haven't made every payment on time, we HAVE PAID our payments. We have gone through multiple forebearance notes and the like but they are leaching every cent out of us to the point that we are near 1 payment being 1/2 half of my monthly salary which is unaffordable, obviously. No mortgage company (I am a decorated Combat Veteran as well) will help us due to our credit?It is no use calling and being placed on hold only to argue with them, AGAIN, about this. I am pulling my hair out over this, have lost sleep, have related blood pressure and digestive problems over this with them. We thought that buying a house would be better than paying rent on a house with 6 acres for 2/3 less of what we are paying for our house!We are most likely bound to give up the house and revert to renting again.If anyone has any lines on help (I have read with great interest the other blogs reference Ocwen and of the 2 Class Action Suits against Ocwen) we would be eternall thankful.

Ocwen Loan Servicing Mortgage Fraud equals Ocwen
Ocwen has been my loan servicer for my home loan since 1998. Over that time, I have had numerous foreclosurer notices and even had to obtain attorneys in fighting them. Ocwen does not record payments made and issues statements that are in conflict with each other. In 2002 my attorney spelled out in 33 points, exactly the same points that are included in the Class Action Law Suit that is occuring in the state of Illinois, I have a court stamped document to testify to this. Even the court document did not change their practices of charging large fees and expenses, not crediting payments and charging for insurance even after I have faxed them copies of my insurance declaration sheet. The service representatives are always ready to create forebearance plans that, in my case, reached an extra $300.00 more per month. Even, if I made the payments in a timely fashion, for some reason they were never credited on time to my account. When I made the forebearance down payment, which always consisted of $3,000.00 or more, I was never given statements to where this monies had gone. In 2006, I received a short statement of fees that they were going to waive, totaling of approximately $12,000.00 This was never credited to my account. Why wasn't this applied to my loan? Over the years, I have asked for statements,either on the phone, or on the internet and never received them. In fact, I sent one letter to an attorney in Cleveland Ohio who represents Ocwen for a complete accounting of my loan. That was in 2005 and I have never received it. At the end of 2007 after payments that were never credited to my account, they wanted to put me back on another forebearance plan, after about 3 or theses, I did not want to be put back on another one. They wanted to raise my payments. Also, Ocwen would make promises that if I would make 12 payments on time that I would be taken off the foreclosrer /forebearance status and that when I signed up for the forebearance that it would be reported to the credut bureau as paid up to date. This never happened. The 12 months came and gone and nothing, during that time was changed. In 2008, Ocwen decided to offer me a modification plan. The plan looked like a dream come true, but when I asked questions ie if I would be charged expenses at the end of the loan? How much would my payoff be if I sold the home? and if there would be early payment fees applied, they could not give me an answer. I made numerous calls and was put on hold for up to 2 hours, and when someone did try to help me, I had numerous different answers. I even wrote the ombudsman and still did not receive the answers to my questions, they would beat around the bush about the questions. I needed answers in writing before I would sign. They offered me another modification in May and again the same thing happened. I did not sign. In the meantime foreclosurer papers came, The Bank of New York as successors to Chase Bank was the loan owner on the lawsuit. I called both of these and even Chase Subprime loans and all stated that they had no interest in my house. Who is the 'party of interest' OF my loan? I still do not have a real answer Ocwen did not answer this for me and neither did the their attorneys in this case Today, July 28, 2008, my home of 24 years was sold at a sheriffs sale. This Is FRAUDULENT I have filed a complaint with my states Attorney Generals office and with the Fair Trade Commision in Washington DC. I have discoved the Class Action Law Suit that is taking place in Illinois and have written that attorneys office. I will be obtaining an attorney for my individual lawsuit. I am not going to stop fighting until Ocwens doors are shut. They are predators and they need to be stopped from their deceptive practices. I may lose my home because of them, but I think they will lose their business also. Have you noticed their stocks are going down and their business is dropping. Maybe a Large Class Action will finish them. What a shame that companies like theirs exit. Maybe if it wasn't for their dishonest ways, the housing market would not be plunging and banks would not be closing their doors. Most of us who are subprime did not cause the problems, companies like Ocwen has. Their main customer relations department is in India, could that be the reason communication problems existed at times Why as the United States of America, are we shipping our business out of our own country? I wonder if its the number from India who calls me, sometimes up to 4 times daily and as soon as I answer it hangs up? I call this harrasment.

Ocwen Loan Servicing - Aegis Mortgage Co. mortgage companies Orlando Florida
My husband and I refinanced our home with Aegis Mortgage. after awhile, we got a letter stating Ocwen was taking over and we started having to pay Ocwen. We were not notified of any changes. when we were finally able to contact a person at Ocwen, they informed us that they were a collection agency for Aegis Mortgage.
Over 6 months, our interest rate sky-rocketed to 13.5%. Ocwen told us it was because we were behind (had a hardship and got a month behind, but were still making payments to them for the entire next 2 months and actually catching up).
As we were trying to catch up, we asked if they would refinance for a lower interest rate. They said absolutely not and that they were just a collection agency for Aegis.
We tried and tried to contact them and finally got some guy that could barely speak English. After trying to speak with him, he told me that they would work with us and send us a packet of paperwork. 4 days later, while we waited for the paperwork, we received a forclosure notice. After calling them and asking why, they informed me they decided to forclose instead of work with us.
We had to spend $1500 and hire a Loss Mitigation company to help us out of the forclosure.
Today, we were told by the Loss Mitigation firm that Aegis went bankrupt and Ocwen was our mortgage company. I thought they were just a collection agency for Aegis?SO....Ocwen decided they are now going to work with us and offered us a loan restructure. after we sign the contract, they have reserved the right to add on all fees accrued from the original forclosure.
Don't need a law degree to know NOT to sign that one!

Ocwen is holding my money for ransom Palm Beach Florida
OK, this is complicated so stay with me. Ocwen took over loan servicing from Bayrock Mortgage in 2006 on rental duplex building. In September 2007, I stopped making mortgage payments, due to both a dispute with Ocwen and deadbeat tenants. In February 2008 the building burned down. My tenant was arrested for arson. I had not been served any foreclosure papers at that time, nor had I received any notice of acceleration at all.
The property was insured for replacement value. I was served with foreclosure papers after I notified them that the place had burned down. They continued to pursue foreclosure. I went in front of Judge Graham in Volusia County, and explained that an insurance payoff was pending and he told the attorney that he would not rule on any foreclosure until the insurance was settled.
I had filed a motion to set aside the lis pendens because of the fire. And also argued in my answer to the foreclosure complaint that predatory lending may exist at loan origination; that they had failed to send me anything to accelerate the mortgage; that they had charged mysterious fees on my account; and the plaintiff in the law suit lacks standing. The plaintiff is HSBC Bank, trustee for asset backed securities etc. I can't find anywhere where HSBC has any interest in this loan. The judge was pretty interested in that tidbit. Judge Boyko ruling against Deutsche Bank, if you're interested. They also stopped sending any statements out to me when I requested a mortgage modification back in September.
The amount of insurance is well over the mortgage amount. After jumping through all of the hoops of the insurance company they finally paid the entire claim, check payable to the owner and Ocwen jointly. Signed the check and sent it to Ocwen. There was nothing else I could do. I have the payoff in writing with letters acknowledging that they received the check.
After they received the check I received a settlement agreement that they want me to sign that signs all my rights away. And the language in the settlement agreement is that if I don't sign it they will return the money to the insurance company and continue to foreclose. I have written a letter to the Ocwen attorney that I am dealing with stating that I will not sign that settlement agreement and they better give me back my money anyway or I'll just have to let the judge decide. I plan to fax it to the attorney on Monday.
Now, interestingly, the attorney for Ocwen that I'm dealing with is in Alabama. I'm in Florida, the property is in Florida, and the Ocwen customer service people I deal with are in Orlando, Florida. That settlement agreement was faxed from her office in Alabama, but has the name of another Florida attorney at the end of the agreement. These are different attorneys from the foreclosure attorneys, Fishman and Shapiro, who were doing the foreclosure. Those guys are more or less like cyborgs, only know one thing. Foreclose.
Does anyone know if that is unlicensed practice of law in Florida? An Alabama attorney preparing a settlement agreement for an insurance property damage refund for property in Florida. FAxed from her office, I dont care whose name is on it.
I probably would not have gone after Ocwen for their business practices if they would have just sent me my check. But now that they're making it difficult and the language in the settlement agreement is so one-sided and self serving, I must have a claim for further damages. They would not negotiate away any of the fees at all on the payoff, even though they knew that the property had burned down, I had to continue to be responsible for the full mortgage amount. They also refused to waive a prepayment penalty. And out of the excess insurance money I am also having to pay attorney's fees when they should have just waited for the insurance money to begin with.
I had to jump up and down and scream and shout to get Ocwen to even acknowledge there was a fire. The attorney in the court hearing in May, after Ocwen was informed of the fire in February, said, oh yea we got some pictures. They got pictures of a burned out building and continued to pursue foreclosure.
I'm hoping one hand doesn't know what the other is doing and customer service will just mail me the check. On Thursday they said that they would. Otherwise I have to back down this attorney or go talk to the judge. The Bar Associations, this Alabama attorney's bosses, and everyone else is going to hear my story.

03/94 I entered into a forbearance agreement with HUD. I was convinced by HUD and Lincoln Service Corp. that this was necessary. I was very confused why this was needed. The forbearance agreement would save me $18.35 per month and increase my purchase price from $42,900.00 to $43,000.00.

I was not behind on any payments when the collections letters began. At this time, I began sending all payments through Western Union-Quick Collect so I would have documentation of payments made and received.
02/03/99Received Notice of Acceleration from Ocwen, demanding entire amount of $56,927.58 in full. Called the 1-800# provided in the letters, customer service, all they would tell me is the entire amount would need paid or they would foreclose. It took several phone calls to many numbers before someone agreed that only my regular payment was due, not the entire amount. Was informed the demand for payment in full was a computer generated letter sent to all customers. I consulted attorneys to assist in the threats they were making to take my home. The attorneys all wanted $1000.00 - $2000.00 up front with no guarantee. I did not have that kind of money and was afraid Ocwen would take my home.
05/04/99 Received another Notice of Acceleration from Ocwen, now demanding $57,040.08 in full. Again, I called many times before I could speak to someone who explained that only my monthly payments were required. I was not behind in payments when I received this notice.
06/11/99 Received a notice that July 1999 payment amount would be $15,670.19.Called, again I was told that this was a routine mailing, nothing to worry about, just continue making my regular monthly payment.
06/25/99 Ocwen's attorneys filed a suit against me; summons delivered in person on July 1st, demanding payment in full, $41,741.66 on principle and stating foreclosure of property.
07/01/99 Ocwen returned my June and July payments - $772.00.
07/99 Received letters from Ocwen demanding different amounts be paid or they would foreclose, one amount - $16,303.08. Several letters on their letterhead were not signed.
08/02/99 Ocwen returned my August payment - $572.00.
08/04/99 Tried again to find an attorney, with my limited resources. I could not find an attorney that understood the situation or was comfortable suing a bank. I sent a letter to Ocwen stating I was countersuing, claiming wrongful foreclosure, stating they had returned 3 payments in a row to purposely file foreclosure.
08/11/99 I sent a letter to Ocwen requesting information;When did my loan change from 9% to 10%, why and why wasn't I notified? Requested amortization statement, had never received one from Ocwen.. I wanted to know the exact application of my monthly payments.Information returned; 08/01/97 04/22/99 only $462.00 went to principle.
08/99 New forbearance agreement entered with Ocwen. They agreed to put back interest that accumulated, while HUD had my mortgage, to the rear of the loan, which made me current. They will accept my monthly payment and suits against each other would be canceled. I did not know until this time that the forbearance agreement with HUD was so damaging, that none of the money I paid HUD, $15,525.00, went toward my mortgage.
09/99 Ocwen again sent back my monthly payment, $400.00.
11/99 Ocwen sent me another letter of acceleration demanding; $19,650.00. After the above arrangements were made and they convinced me everything would be fine, I would not lose my home, they again began sending letters demanding huge amounts or I would lose my home.
12/01/99 Filed Chapter 13 to save my home. Payments of $250.00 made to; Terry Smith, Clerk of Court, Tampa, FL.
07/31/00 Chapter 13 hearing, resume payments to Ocwen, per court order.
09/12/00 Ocwen sent an acceleration notice, full amount due - $67,286.65.
10/04/00 Ocwen filed for mediation to resolve differences. I appeared as directed, no representative of Ocwen present. The hearing officer reschedule, again I attended but no one from Ocwen attended. The hearing officer dismissed the mediation, failure to attend by filing party, Ocwen.
10/13/00 Received new forbearance agreement from Ocwen stating $1000.00 down and monthly payments of $517.00 per month.
03/22/01 Court dismissed Chapter 13.
06/30/01 Met with manager of Bank of America to refinance my home and get away from Ocwen.Ocwen refused to cooperate and would not sell my mortgage to my bank.
09/21/01 Notice of intent to terminate forbearance agreement received from Ocwen, amount due,$6239.53.
11/09/01 Ocwen again filed foreclosure on my home demanding; $65,901.38.
12/06/01 Received another letter from Ocwen now demanding; $6952.68.
12/07/01 Filed another Chapter 13 to save my home. Again I could not afford an attorney to assist me with problems by this mortgage company. The attorneys I spoke to did not understand HUD purchased houses or what Ocwen was wrongfully doing.
07/09/02 Ocwen attempted to convince me to cancel the Chapter 13 and reinstate a forbearance agreement again. I refused because they had lied so many times and I did not trust them. Somehow, they convinced the court that they had the right to foreclose and the foreclosure sale of my home was scheduled.
08/02 I contacted an attorney to handle a Chapter 7, my 13 was converted to a Chapter 7.
They would not assist me with anything prior to the Chapter 7 because they would be entering after the fact and for liability reasons could not be involved with the circumstances of the past two years. In Florida you can keep your home when filing a Chapter 7, but since Ocwen prevented me from making payments, I was behind and did not qualify, and would lose my home.
05/03 Phone hearing to resolve Chapter 7 took place. Chapter 7 discharge set for June 2003.
09/03 Contacted the courts for copies of my discharge documents. It was not filed in June as scheduled, but they would file it now.
03/04 Received notification from Ocwen, stating the outstanding balance on my home of $41,268.77 is resolved with the Chapter 7 and fair market vale is $60,000.00. I was not provided a penny of equity even though I made 10 years of payments on my home.
All the stress and worry during the time Ocwen took over my mortgage caused problems in other areas of my life. I lost a lot of time from work for court appearances, etc. I worked for the State of Florida. I was terminated from my 15 year career job.
Ocwen stole my house from me after 10 years in my home. They caused me to lose my career job of 15 years, they ruined my credit and left me with nothing.
I am very interested in suing Ocwen for the damages they have caused me, loss of my home, my career & benefits lost. Ocwen should be held accountable for the damages they have caused us home owners. Several home owners only had a one time shot at home ownership and Ocwen ruined them for life. Thank you for listening.

The attorneys all wanted $1000.00 - $2000.00 up front with no guarantee. I did not have that kind of money and was afraid Ocwen would take my home.
05/04/99 Received another Notice of Acceleration from Ocwen, now demanding $57,040.08 in full. Again, I called many times before I could speak to someone who explained that only my monthly payments were required. I was not behind in payments when I received this notice.
06/11/99 Received a notice that July 1999 payment amount would be $15,670.19.Called, again I was told that this was a routine mailing, nothing to worry about, just continue making my regular monthly payment.
06/25/99 Ocwen's attorneys filed a suit against me; summons delivered in person on July 1st, demanding payment in full, $41,741.66 on principle and stating foreclosure of property.
07/01/99 Ocwen returned my June and July payments - $772.00.
07/99 Received letters from Ocwen demanding different amounts be paid or they would foreclose, one amount - $16,303.08. Several letters on their letterhead were not signed.
08/02/99 Ocwen returned my August payment - $572.00.
08/04/99 Tried again to find an attorney, with my limited resources. I could not find an attorney that understood the situation or was comfortable suing a bank. I sent a letter to Ocwen stating I was countersuing, claiming wrongful foreclosure, stating they had returned 3 payments in a row to purposely file foreclosure.
08/11/99 I sent a letter to Ocwen requesting information;When did my loan change from 9% to 10%, why and why wasn't I notified? Requested amortization statement, had never received one from Ocwen.. I wanted to know the exact application of my monthly payments.Information returned; 08/01/97 04/22/99 only $462.00 went to principle.
08/99 New forbearance agreement entered with Ocwen. They agreed to put back interest that accumulated, while HUD had my mortgage, to the rear of the loan, which made me current. They will accept my monthly payment and suits against each other would be canceled. I did not know until this time that the forbearance agreement with HUD was so damaging, that none of the money I paid HUD, $15,525.00, went toward my mortgage.
09/99 Ocwen again sent back my monthly payment, $400.00.
11/99 Ocwen sent me another letter of acceleration demanding; $19,650.00. After the above arrangements were made and they convinced me everything would be fine, I would not lose my home, they again began sending letters demanding huge amounts or I would lose my home.
12/01/99 Filed Chapter 13 to save my home. Payments of $250.00 made to; Terry Smith, Clerk of Court, Tampa, FL.
07/31/00 Chapter 13 hearing, resume payments to Ocwen, per court order.
09/12/00 Ocwen sent an acceleration notice, full amount due - $67,286.65.
10/04/00 Ocwen filed for mediation to resolve differences. I appeared as directed, no representative of Ocwen present. The hearing officer reschedule, again I attended but no one from Ocwen attended. The hearing officer dismissed the mediation, failure to attend by filing party, Ocwen.
10/13/00 Received new forbearance agreement from Ocwen stating $1000.00 down and monthly payments of $517.00 per month.
03/22/01 Court dismissed Chapter 13.
06/30/01 Met with manager of Bank of America to refinance my home and get away from Ocwen.Ocwen refused to cooperate and would not sell my mortgage to my bank.
09/21/01 Notice of intent to terminate forbearance agreement received from Ocwen, amount due,$6239.53.
11/09/01 Ocwen again filed foreclosure on my home demanding; $65,901.38.
12/06/01 Received another letter from Ocwen now demanding; $6952.68.
12/07/01 Filed another Chapter 13 to save my home. Again I could not afford an attorney to assist me with problems by this mortgage company. The attorneys I spoke to did not understand HUD purchased houses or what Ocwen was wrongfully doing.
07/09/02 Ocwen attempted to convince me to cancel the Chapter 13 and reinstate a forbearance agreement again. I refused because they had lied so many times and I did not trust them. Somehow, they convinced the court that they had the right to foreclose and the foreclosure sale of my home was scheduled.
08/02 I contacted an attorney to handle a Chapter 7, my 13 was converted to a Chapter 7.
They would not assist me with anything prior to the Chapter 7 because they would be entering after the fact and for liability reasons could not be involved with the circumstances of the past two years. In Florida you can keep your home when filing a Chapter 7, but since Ocwen prevented me from making payments, I was behind and did not qualify, and would lose my home.
05/03 Phone hearing to resolve Chapter 7 took place. Chapter 7 discharge set for June 2003.
09/03 Contacted the courts for copies of my discharge documents. It was not filed in June as scheduled, but they would file it now.
03/04 Received notification from Ocwen, stating the outstanding balance on my home of $41,268.77 is resolved with the Chapter 7 and fair market vale is $60,000.00. I was not provided a penny of equity even though I made 10 years of payments on my home.
All the stress and worry during the time Ocwen took over my mortgage caused problems in other areas of my life. I lost a lot of time from work for court appearances, etc. I worked for the State of Florida. I was terminated from my 15 year career job.
Ocwen stole my house from me after 10 years in my home. They caused me to lose my career job of 15 years, they ruined my credit and left me with nothing.
I am very interested in suing Ocwen for the damages they have caused me, loss of my home, my career & benefits lost. Ocwen should be held accountable for the damages they have caused us home owners. Several home owners only had a one time shot at home ownership and Ocwen ruined them for life. Thank you for listening.

Hi, My name is Janet Purdy, at 7866 Mansion House Crossing, Pasadena, Md. 21122, 410-437-5275 fell free to call me. Please read the whole story. I need HELP.Ocwen Bank has stopped every action for me to save home they used a trustee that came after me like it was personal. And since the buyers bought my home two times at auction the first time for 235.000.00 and the second time for 191.000 I am thinking Bierman,geesing, & ward the trustee had deal with Dave & Sharon Wuest the buyer. My home is worth 352.000.00, I will be only getting about 20.000.00 which the trustee is going hold until July, my family and I will be homeless by evction in about two weeks. Do to me being disabled I do NOT have money to move and we have no where to go Maryland has NO help for use the selters have waiting lists. I am also a widow since 2005 and I gave Ocwen every cent I had my payments where not appiled to my correctly.I am disabled; caring for her elderly mother with a heart problems moms 80 now and a special needs child and one child in school until June he's 15, all will suffer irreparable harm should this court allow Respondents to fraudulently move forward with their illegal eviction. This is only a small part of what happened to me there is much more to my story.And why is it the opening bid opened for less and less money? ILoan documents signed May5,2007 for refinance of my home with 1st Metroplitan mortgage this could have saved the home, but the TRUSTEE, Bierman, Geesing and Ward REFUSED to take the money to pay off the loan and the home went up for auction on May 8,2008. Notice of pending auction received eight days before aution byJanet Purdy. At that time the house was appraisaed at 350.000.00. Auction took place May 8,2008 the opening bid was 263.000.00 and sold this sale was RATIFIED AND CONFIRMED a Motion was filed for unclean hands the sale was recinded because of payment disputes.Loan documents where signed Sept.9,2007 my appraisal was done on Oct.1,2007 the home appraised at 352.000.00 payoff quote was faxed to SRI Mortgage on Oct.5,2007 from Ocwen. Some time in Oct.2007 my home was auctioned with an opening bid of 235.000.00 NO Notice was sent to me via by certified mail or first class mail on Oct.31,2007 Dave and Sharon Weust came to my home and handed me a one page note that they bought my home at the opening bid of 235.000.00 which was RATIFIED AND CONFIRMED my Motion for a Stay was not ruled on at that time. That auction was taken back, because of lack of service by the TRUSTEE, I was told my home was going to auction again in Jan,2008 it was on the auction list for Jan.,2008 at some point it was moved to Dec.28,2007.Loan documents where signed again with another Motrgage broker a payoff was requested from Ocwen but it was never sent to my broker which stopped the process for my refinance. Again NO Notice was sent to me about another auction the opening bid was 191.000.00 this time I was NOT notified by Certified Mail or by Dave and Sharon Weust until after the house went to settlement taking away rights I had to file a Motion or fight for my home. Which would be a violation of my rights.[In Violation of ]: The Fourteeth Amendment to the U.S.Constitution : 'No State shall...Deprive any person of liberty, or property, without due process of law'[Article 24 of the Maryland Declaration of Rights:] '[N]o man ought to be taken or imprisoned or disseized of his freehold, liberties or privileges, or outlawed,or exile, or in any manner,destroyed, or deprived of his life, liberty or property, but by the judgment of his peers, or by the law of the land.' I do not no where to go or what to do. My mental state is so bad I can't think any more, I did appeal the eviction but I don't think that will help and I aiso appealed to the speacial court of appeals but I don't think that will work. So I just keep packing I do not where I will put my stuff and I know I will lose my pets that I LOVE every much. I know I have failed myself and my family, Life is just not worth living any more.Thank You,

ocwen has sent me a modification agreement to my Loan for me to sign, if i agree to sign it i give up all my rights to pursue anything from them but if i dont sign it i could be forced into forecloser on, based on prior servicer fees,previous bankruptcy expenses and legal expenses they are charging me . I'm not behind on any payments nor have any been missed,I have called them many times and it doesn't do any good,calls are rerouted to a call center in india,where you get someone you can't understand, and you get no where. They tell you their research team will get back to you and it could take up to 15 days.Why is this Company allowed to Operate in this Country and where is the Goverment to protect it's people from wolves like this.it just goes to show you the little people have noone to stick up for them.
